newly blind person in jail (self.Blind)
submitted by jezebella47
Hi, I'm trying to determine if there are advocacy organizations or other resources that will help a newly blind person in jail. The person in question is in jail awaiting trial (not prison) near Mobile, AL. The staff think she's faking because she has some peripheral vision (sigh), so they ignore it when other prisoners bully her or steal her stuff. She lost her vision due to a brain tumor last year, so she's also recovering from major brain surgery. I see a lot of resources in my googling, but can't tell if any have programs for the incarcerated.

Related, is the ADA definitely known to be applicable to people in jail? I would think so, but you never know when it comes to rights for the incarcerated.

thanks!

You or her lawyer should be able to get medical documentation to prove her blindness making it easier to demand documentation.

Sorry as a blind person the only experience I have is talking to another blind person who once spent some time in prison. He was in state prison though and kept in a different wing.

The ADA definitely applies in correctional settings. The supreme court found in the case of Pensylvania department of corrections v Yeskey that refusal to allow a prisoner to take part in a particular early release programme was a violation of the ADA. Please see this source for more information, if you need it. $1
