Discriminatory hiring practices (self.Blind)
submitted by prosperoairy
Hello, all,

I know this is well-trod ground, but I would appreciate any advice or good counsel.

Full details below, bit tl;dr
I am convinced that I was denied a job due to my low vision.

The job was teacher, and my vision is high enough to, as I've proved, do the job.

The other person applying for the position was tangibly less qualified than me, except she is not visually impaired.

When I asked why this person was hired over me, I received the most superficial response that was only tangentially related to the job.

Of course they won't admit that my disability was the reason for denial, if it is true

Do I have any recourse?

Thank you for any advice: I am admittedly at the end of my rope and coming to that point where I question whether continuing to strive for anything in this world is worthwhile.

I'm no lawyer but you essentially need a smoking gun... A copy of someone saying we shouldn't hire x because of vision problems.

If things are grey, you might find a lawyer willing to try to extract a settlement but no guarantees that will even come close to working

Agreed. Honestly not worth your time, even if you win and they give you the job do you really want to work in a team with a toxic environment?

Move on find a better situation, I know it sucks and isn’t fair but it’s the reality.

So, I am a teacher and I wasn’t traditionally qualified with an education degree, but I have a masters in my field. I got a lot of rejections, but finally a private school hired me. Although, I did the interview over Skype and didn’t tell them until after the fact that I am blind. I am happy to talk teaching logistics with you. Unfortunately, discrimination is really hard to prove.

I often wish those laws didn’t exist. I would rather hear the truth and know I was dealing with an asshole than wonder if I really was less qualified. It just proves that you can’t legislate doing the right thing.

Oh my god, I can't tell you how much I feel this, dude...

I'd first start by seeking out either a peer-supoort counselor or a disability advocate.
You might also be able to try talking to your local or state officials directly.

I really, really understand your frustrations... I got covertly fired from my last job because they kept sabataging my ability to work so I'd have to quit. Learned after I left, a coworker overheard the managers talking about it, but they didn't have any audio or video proof. So, I kinda work for myself, now.

I know it's a strech, but, maybe put out some ads for tutoring students at a mostly busy location!
I apologize if you've already tried that...
I don't want to assume anything more, so if you're comfortable with talking about it more, I could help you brainstorm some more ideas. Just let me know by commenting or messaging me.

I hope things look up for you!!! I really, really, REALLY do!!
Been in your position far too many times...

Constructive dismissal happened to you.

Would you look at that, all of the words in your comment are in alphabetical order.

I have checked 24,241,063 comments, and only 7,385 of them were in alphabetical order.

Oh god I feel for ya. Could there be a free legal board you could go to for advice. Can you get the rejection and reason in writing?

I imagine it's a hard one to prove, in any case, not just here. He said she said sort of thing. But pursue for sure, it's the only way to get places to change.

Good luck

Im pretty sure I wasnt hired at a competing optometry office when I applied for the ophthalmology office i work at now and that one at the same time. I was qualified for both, over so for the optometry office but I am sure my hearing and eye sight turned them off. Whereas the job I have bow saw it as a bonus because I can relate to the patients better. Honestly im glad they denied me, I won in the end.

If you're in Australia, go to the Human Rights Commission. They deal with pre-work discrimination.

If not, is there a similar organisation that can help you in your country?
