Disability claim with RP (self.Blind)
submitted by richardloeb
Has anyone with RP filed for disability?
My mom ( withRP) was denied because they said she didn’t meet standards but her doctor and retinol specialist said she should meet criteria.
She has field test done and “failed.” Her vision is 20/80 in right eye and no vision in left eye.

We’re struggling financially and are not sure if a lawyer is worth the money.

Anyone help/insight is welcome! Thanks!

Legally unless she has less than 20 degrees of visual field from point if fixation in her *better* eye then she cannot qualify for benefits because she would not be considered legally blind. So unless she has a very constricted VF in her better eye, unfortunately she wont qualify. My visual field is 15 in left and 20 in right, so i am considered legally blind, though i would not be surprised if your mom has more difficulty with vision than me. Its terrible I know, wish there was a better answer.

She has 1 VF in left eye and 4 in right. She has vision field test done a few weeks ago.

Then google SSA Legally blind form. Have an ophthalmologist sign the paper and state that she has under 5 degrees of vision in her better eye. Make an appointment with SSA for disability. If she currently works, she can make up to 2190 dollars a month and still receive benefits for SSI. She definitely qualifies for legal blindness, and from the sounds of it she shouldnt have an issue arguing that she cannot have gainful employment.

>You may qualify for Social Security benefits
or SSI payments if you’re blind. We consider you to be blind if your vision can’t be corrected to better than 20/200 in your better eye or
if your visual field is 20 degrees or less in
your better eye for a period that lasted or
is expected to last at least 12 months.

In the US, if she had a visual field test, Goldman or Humphery, then her peripheral vision must be less than 15% to qualify. I don't think they care about the 20/80 so much.

Did she go to a specific location that they use for their testing? I had to travel 150 miles away to one of their facilities.

So, the insurance company (this is disability through her work) denied her on the first saying that she didn’t meet the threshold (20/200). She hadn’t done the field test the first time and it’s less than 15 %. The test was done at her optometrist’s office and then she saw a retinal specialist but the insurance co didn’t send her there. This is all in preparation for her appeal
