My guide dog and I got kicked out of a restaurant. (self.Blind)
submitted by sunny1sotrue117
This isn’t the first time this has happened, but the manager was so rude when telling me to “get out” because i had a dog inside that I would like to seek some kind of action. I tried to contact NFB a month ago but received no response. I’d just like the manager to know that he was in the wrong, I don’t necessarily wish to seek legal action. Any suggestions?

Take legal action. We've been far too forgiving when advocating for our needs, if this was any other marginalised group getting kicked out of a restaurant it'd be the sort of thing that destroys his business. People like this need to be taught a lesson, and if he's forced into paying out costly damages it'll serve as a reminder to others who might feel like acting like him.

Thanks. Good point

Local news / advocacy groups is probably your best bet if you don't want to get an attorney. However, I'm beginning to think that legal action is required to make positive changes. If you're in the US you probably can find a local plaintiff's attorney who would hear your case for free. Furthermore, I believe the ADA has fee shifting provisions which should make taking the case more appealing for any attorney.

Sorry you had to experience this. Good luck.

I brought a different case to the ADA and they dismissed it after 90 days. I’ll look into nearby attorneys, thanks
bayou_firebaby 6 points 1y ago
The ADA is a law, not an entity. The US Justice Dept. is the responsible entity.
dreaminghope9 22 points 1y ago
Local news would probably eat that up. If there's a segment that's about consumer rights or similar - often called something like "name on your side" - they might do it. Good luck!

I’ll look into it. Thanks

Guide Dogs of Texas is currently dealing with a similar occurrence with one of their admin and clients. They may be able to provide some guidance.
sunny1sotrue117 [OP] 3 points 1y ago
If neither me nor my dog is from Texas, would they still be willing to help?

Call up the school you got your guide dog from. I've raised puppies for two schools and both of them would absolutely call that restaurant in a heartbeat and ensure they are aware of the laws and protections their clients deserve. If anything, you've got nothing to loose by giving them a call!

Best of luck, it's hard enough being kicked out as a puppy raiser and arguably there's gray area for said puppy raisers but I always hoped I could provide some education about the ADA and guide dogs.
sunny1sotrue117 [OP] 1 points 1y ago
I’ll do that. Thanks

Outside of what else has been mentioned here, leave a 1 star Google review outlining your experience. A LOT of people will see it.
niamhweking 9 points 1y ago
Yes or twitter? Nice and polite. Just stating " I was asked to leave @burgerrestaurant last month for having my guide dog with me. Can you explain why you broke the law. Statute/regulation no136927a"
sunny1sotrue117 [OP] 1 points 1y ago
Thank you!

Tag local politicians, chamber of commerce, or any group that business is a part of (franchise, anyone who's given him a rating or any group he has a sticker on his door for giving him their approval)
sunny1sotrue117 [OP] 1 points 1y ago
Will do, thank you

For years I've had problems with my township not enforcing snow removal from the sidewalks. Took photos, submitted complaints and nothing happened except for ignoring my subsequent emails. Had to go through the "right to know public documents" to prove they did nothing. Upon sending photos of their own unshoveled sidewalks they sent me a letter claiming harassment and banning me from contacting them via phone or email. This from a local municipal government and sending copies to the police department and their attorney.

I spent weeks in your shoes trying to figure out who to contact and how to advance my case to show them they are terribly wrong.

Here is a start; $1

Since I live on PA, USA my state and local services will be different than yours but might find a parallel service in your area.

Nat Federation of the Blind was contacted multiple times with little or no response. Quite disappointed. Why should I donate in the future?

Sent my 25 page pdf to the Dept of Justice and eventually was told "thank you" but they won't get involved.

Sent a photo and text to my local newspaper. No action from them as I doubt they every reported on it.

I called and complained to a local disability empowerment group that educates businesses about their responsibilities. $1

I contacted a state run group fighting for the rights of the disabled, $1 They were great in giving me information and taking my statements and photos. They personally decided not to represent me. They did have names of pro bono lawyers available.

Contacted the state and filed a civil rights claim. $1 This got the most action as the state has little tolerance for government agencies ignoring the ADA. Still waiting on the final verdict.

All this was from last winter. Can't wait for it to snow this year.

I suspect you could give a Yelp review about your restaurant experience. Some will see it when searching online.

Hope you can find some local resources for help.

Thanks. National federation for the blind has not responded to me as well. Good luck with the snow this year I really hope it gets plowed!

Hi, which chapter do you belong too?

I’m the kind of petty asshole who’s going to make them force me to leave, go ahead, call the police, see what happens.
sunny1sotrue117 [OP] 2 points 1y ago
Oh yeah. I was that asshole. I was told to stop harassing him and GET OUT. But I was petty in the nicest way possible and even read him the laws while he was yelling at me.

I can’t offer you any better advice than other kind folks have already offered but I just wanted to say I’m sorry this happened. I had a guide dog for about a decade and I remember my roommate and I going to check out a possible apartment and the landlord lady wouldn’t even let us come in because of the dog. I was so frustrated and I knew I was being discriminated against, but the property wasn’t all that great anyway and if this was going to be the person running things, it just wasn’t worth putting up a fight. Still though, I know how angering, insulting and humiliating that can be. You definitely experienced blatant discrimination and I hope you take some kind of action. People need to understand they can’t get away with this nonsense. Good luck!
sunny1sotrue117 [OP] 1 points 1y ago
Thank you and I’m sorry that happened to you.
BlindGuyNW 6 points 1y ago
Name and shame them I'd say. This is clear-cut nonsense.

Will do, thanks!

*Name that POS restaurant and internet will do the rest*
sunny1sotrue117 [OP] 1 points 1y ago
Haha okay thanks

If you can’t reach NFB, you might try a Disability Rights organization. There are different chapters in each state, and you can $1. Good luck!
sunny1sotrue117 [OP] 1 points 1y ago
Thank you so much!

Sorry that happened. I have been denied a handful of times for taxies and diners. In some cases I don't even bother to fight it, especially if it is due to cultural feelings towards animals indoors. I've definitely had a few China Bufets slam the door in my face. Was typically asian drivers or restaurants. I have some fam down south that can't deal with the dog hair or animals in their house. They believe dogs should be out on the farm and not indoors. You better believe I through a fit at the taxi driver though. That dude was trying to strand us after bar hopping and going out to eat until 2 in the morning in a dangerous neighborhood. I know their is ADA but I try not to be an ass. You better believe though, there are some ACB and NFB members I hang out with that will litigate your China Buffet in a New York minute. There is your states disability rights offices. Do some googling. Say for example, Indiana has IDR or Indiana Disability Rights. There is also the department within the major city disability rights commission. Worse comes to worse you can hit up equal opportunity commission on the Federal level. They take complaints as well. Sad it has to come to that. Again though, I try to be culturally sensitive when I can. In many cultures it is not uncommon to see folks that appreciate doggies as much as us here.

As passive as it sounds, leaving a review on their Google business / other review channels can be good. 9/10 people are going to be on your side about this and hopefully, would think twice before giving this guy any further business.

I know it's not much, but it's a start.
sunny1sotrue117 [OP] 1 points 1y ago
Will do, thanks

Morris Frank used to be told to leave establishments with his guide dog when he was the only one in the states with one. He’d sweet as pie go outside and tie his dog up without issue then proceed to bump into and knock over every table on the way back in to prove a point. If you don’t want to go through legal actions, sometimes repeated interactions with people whose service dogs are not obtrusive can wear them down.

That’s amazing
