Does anyone know what resources are available to research the call sick policy for Starbucks in California?

Throwaway account for obvious reasons, but my store has made a very clear policy that you cannot call out sick unless you find someone to cover for you. In a severely understaffed store (we have about 10 coworkers), that never happens. We can call other locations but I have called every one in the district and no one can come cover. So, right now with a huge fever and puking, my supervisor and manager both told me to come in anyway.

A few months back we had an incident where the entire team caught bronchitis because we were forced to come in while sick. I got written up for staying home one day because of how sick I was. The entire team was written up; one person wasnt written up because she had a doctors note and argued with the manager over it. I had a doctors note too but was never asked for it, and I was told being written up was mandatory. I only found out weeks later about the girl who argued to not get written up. Its probably too late for me to do that now.

I’m concerned because this is a food service job, and its wildly innapropriate to require coworkers to come in while sick with contagious illnesses. I used to work at Panera before this, and I wasnt even allowed in the building if I was sick. I’m really concerned about this policy because I can’t imagine its Starbucks policy to endanger guest health this way.

I tried calling the policy hotline but since its Sunday, they’re closed. Does anyone have any info for me? For now, I already told my supervisor I’ll be in the bathroom most of my shift.

Edit: Since people always ask with this kind of thing, her words exactly were “You need to find the coverage”

Partner Handbook pg 20 -
- Finding a Substitute: If a partner knows in advance that he or she will be unable to report to work for a scheduled shift, it is the partner’s responsibility to notify the manager and to arrange for another partner to substitute. **In the event of sudden onset of illness, injury or emergency, or when the partner is using paid
sick leave allowable by law, the partner will not be held responsible for finding a substitute, but must still notify his or her store manager or assistant store manager of the absence prior to the beginning of the shift** so the manager can arrange for shift coverage.

Yeah, if you’re sick, the manager is responsible. You’ve done everything you can (more than required) and if they try to penalise you, call your DM/PCC. Also do not go into work, it’s illegal for you to go in with a fever/vomiting and all you’ll do is make everyone else sick. Then you’ll REALLY be short-staffed.

Thanks- I’m reading these replies from my store while I’m at work feeling like puking. Hopefully a call to HR can fix this since the DM also doesn’t care :(

Thats what I thought, and told that to my old manager (whom left the company after the bronchitis incident). And she told me that only applies to life threatening emergencies. Hopefully when I call the partner hotline they can clear it up.

Even if it did only apply to life threatening emergencies, and it doesn’t, this is one! In 1918, 6% of the worlds population died due to the flu!

According to the handbook and health dept if you’re vomiting, have a fever, or the shits you should not be working since it’s probably contagious. I’m licensed which may be different but they go by the Starbucks illness policy which is if you’re spewing from any orafice you need to stay home and it’s up to the shift to flex and adjust plays. Feel better soon!!! Jade citrus mint and mint majesty helps nausea as well.

This is 100% not Starbucks policy. If you are sick (especially throwing up or diarrhea) you SHOULD NOT be going into work and you DO NOT need to find coverage (though it's nice to try to find someone, but if you dont you are not required to come into work). I would reccomend speaking with your DM about this bc this goes against sbux policy

Just Fyi I'm guessing the reason your manager didn't ask for the doctor's note is because (I've been told) Starbucks had a rule that a manager can't ask for a doctor's note... Presumably to protect partners without insurance or who take mental health days.
But regardless, your SM is out of line and that's fucked up. I believe that national food safety laws REQUIRE you to stay home if you've thrown up our had a fever in the last twenty four hours.
