Will it be possible to dispute the outcome for the 3 preferences?(self.starbucksbaristas)
submitted by KingAmrThriving
To make a long story short, I opted for preference 2 (covid leave) but my manager basically told me to not get my hopes up since we do not have many partners in the store, and she would not want to borrow other partners from different stores.
When I told her that current partners could get more hours if I am out, she said that wouldn't work since we need to continue splitting the partners into two teams to avoid possible COVID-19 cross contamination. This did not make sense to me as some partners are scheduled on different teams throughout the week, and I get awakened out of my sleep almost every single morning being asked to cover shifts because people call out (shifts in the other team).
Finally, I asked what would be the criteria to determine who gets granted preference 2 (if two baristas opt for it and you can only afford to give to one of them, how would you determine)? She did not give me any criteria at all. Sounds fishy.
I am supposed to know the outcome by Thursday or Friday I believe. If my preference was not chosen, would there be a way to dispute it?

You can try to negotiate a change with your manager, but at the end of the day you're just expressing your preference. The final decision is up to your manager.

It looks like if you choose 2 and they need you you don’t have a choice. As far as preference they will use seniority. Or if your availability matches needs more than the other partner.

I was just denied preference 2, and told that all of the calls/ zoom meetings in the past few weeks were to gather information to decide if they were going to approve 2 and/or 3. Apparently in my district, some partners were asked if they had preference 2 would they feel comfortable returning in September, and almost all of them said ‘no’, therefore our district decided not to approve it ( at least for me ).

No way to dispute it. Once you goose a preference, you cannot change it. If your SM (it’s actually mostly DMs decision, not SMs) denies it, you will have an option of staying and working (preference 1) or quitting of your own will (which means no severance and no unemployment).

If you´re SM told you not to get your hopes up, that probably means your store is at the correct Target Number of Partners (meaning, your store does not have to lose anyone to LOA or separation). If that´s the case, your SM/DM can deny all requests for option 2. Partners being separated will find out on Thursday. Partners being put on LOA or chosen to continue working will find out Friday. Please be aware that if youŕe asked back to work after choosing option 2, then if you don´t continue, you will **voluntarily** quit your job. You will not be eligible for unemployment nor the 60-hour severance package. This was a new condition added late last night.

It’s actually not a new condition. It’s always been that way (outline in the printout) If you get denied preference two, you can either stay and work or quit of your own will. Nobody can force you to stay and work. But if you decide to leave, it is a voluntary leave which means no unemployment.
