LOA not approved (self.starbucksbaristas)
submitted by farblondjet
Any one else have their LOA (pref #2) not approved? I was told by SM that "they're not approving LOAs anymore because they have the hours to give" and it's just not sitting right with me. I do not get any malicious vibes from this manager at all, only support. Not sure if this is true or if they were perhaps misinformed/instructed to tell me that.

Can someone please confirm/deny? I have only left the house in the last three months for two essential reasons, groceries and protest actions. My partner and I do not have insurance and have been trying to stay home as much as possible and take every precaution seriously. I have cried three seperate times already and had a panic attack since finding out I have to go back in one week.

From what I understand it’s based on your own store/district’s needs. They had us pick ‘preferences’ because they weren’t making promises as a legal distinction. And part of the LOA conditions is that you can be recalled when the business has need for you (found in the description of the options on the PartnerHub).

I know that in my own district, there are many stores with lots of partners and not many hours so partners who took LOA are being covered by those willing to travel for work. But in your district that may not be possible with demand.

Edit to add: Also in the description of options, failure to return to work when recalled could constitute willful separation. I am not sure if it would be relevant here because it sounds like you weren’t given that preference in the first place but IANAL.

Ya everything said here is correct. Our district was like this one, which is a minority, where they actually had more hours available than baristas willing to work. Part of option two was basically being put on call to be called back at anytime at a week’s notice. It was never a really good option to begin with for people that were not looking to come back to work until November. A few option 2’s got denied in our district as well. Option 2’s will start being called back fairly quickly everywhere if sales keep trending up.

The only option 2’s who will not be called back before were start hiring again in our district are: pregnant, obese, severely immuno-compromised, and over 65 partners...so people who are high risk populations to the virus.

Basically corporate’s view, whether you agree with it or not, is that they are paying your benefits while still putting people in a position to get unemployment, in exchange for have experienced partners on the floor at one week’s notice instead of having an unexperienced partner on the floor at 5 weeks notice, so they can staff store quickly as business picks up.

Their view would be, “you want to take an LOA until we have enough hours available? Good news, we had so many people take an LOA we have hours available now.”

It’s all based on each district and store. Sounds like your district has hours to give.
These were preferences which means they weren’t guaranteed. And if it were to be approved, you would probably be called back in fairly quickly. If you were to be called back in, you have to come back to work or quit (voluntary which means no unemployment).
Right now you have 2 options: come back to work and follow all the safety guidelines to keep yourself safe or quit if you don’t want to work. But remember that if you quit if will be considered voluntary and you won’t qualify for unemployment.
At the end of the day Starbucks is a business that needs to make money. They need workers to work.

I feel you. I live with people that could very easily contract COVID, and I’m so tired of everyone pretending like we’re over this pandemic.

I got denied “preference” 2 as well, and honestly I wish I had gone with the 3rd one, idk. Honestly over the fake BS that they’re putting out about safety when it’s absolutely not true.

The LOA was unpaid so unless you've been able to get unemployment this whole time, and since you dont have insurance through sbux, quit.
