On the bright side you get to collect unemployment now which will likely be more than what you were earning
krrizy 9 points 2y ago
i don’t think i can since it was for “misconduct”
Grrrista 6 points 2y ago
I don’t think what you did actually constitutes “misconduct” to the level of being disqualified from receiving UI. I’m pretty confident in that. Like 95%. It may depend on your state. Enjoy your paid vacation.

Being fired with cause, in this case because of attendance issues, is enough to disqualify OP from collecting unemployment.

“... caseworkers often look for evidence of misconduct and an unemployment agency may have a very different definition of "misconduct" than your employer.

In California, for example, being tardy to work once may be enough to get you fired by your employer, but you may still qualify for benefits unless your employer can show that the company suffered serious consequences as a result of your being tardy, according to the California Employment Development Department. In Connecticut, an employee who is fired for absenteeism must have been absent without excuse from work three time in a 12-month period to be declared ineligible for unemployment, according to the Connecticut Department of Labor.”

It tends on the state, but usually it has to be gross misconduct to disqualify you. You may be dismissed for "misconduct" according to companyn policy but not by legal standards
Always challenge denials, too, because it is a corporate legal practice with some companies to default deny because it will save them more money. People assume they have legal standing to do so, when it's actually just a financial strategy.

Regardless of r/thatsmysharpie I’d still apply. Even in Texas you’re in a gray area and they’ll sort it for you.

Also maybe consider talking to corporate. Firing someone for being ten minutes late with notice is not common practice and if you have any reason to believe your manager was biased or unprofessional about your firing that should be explored as well.

I'm sorry that happened to you. Being only 10 minutes late with a call beforehand sounds a rather harsh reason to terminate someone though, imo. Both stores I've worked at have been rather understanding for the most part. Was there some kind of tension that had built up before this happened?

about a month ago i took a camping trip out of town. I had a shift one of the days, but got it covered by a Coworker. However, my coworker never accepted the shift on Partner Hub and did not show up for the shift and my store manager said it was my fault for not making sure he accepted it beforehand (which i guess is correct?) i didn’t have a cell connection since i was out camping so i didn’t even know my coworker never showed up until days after.. :(
