I’ve never been hurt at work so I’ve never had to go through this process but here I am. On 12/12 I was doing dishes in the back of house when the shift lead on the floor came to grab some alternative milks. When she opened the big fridge door it snapped off all its hinges and smacked me in the back of the right shoulder and head. Luckily she caught it before I got flattened like a pancake but it caused my entire back and shoulder to be in constant pain. It took an hour after my injury and me searching for my SM and shift lead to get on the phone with the claims people. They thought there time was better spent cracking jokes about the incident while using tape to put the door back up, it took three days for them to get it fixed.

While on the phone with claims my SM asked if I could stay!! The shift lead on the floor told him shed be sending me home cause I just got hit by a 100+ pound metal door. After I got off the phone with the claims people my DM came into the store and while she was concerned it was more along the lines of when I can come back. I went to Kaiser and got excused for three days. The people at Kaiser just did X-rays and sent me home with painkillers so I decided to go see a chiropractor who said I should be out for at least two weeks or risk injuring my shoulder/back further or forever. I told my SM this and the workers compensation people. Well the workers comp place is trying to say that the day I got hit and the two days after I won’t get paid for because it’s considered a waiting period, that’s a whole weekend so 17-18 hours of work for me.

That’s most of my week first of all and second of all who pays me then because someone needs to. They are also trying to say that since the chiropractor isn’t technically a Kaiser doctor that I need to get a Kaiser doctor to sign off on what the chiropractor is saying. My chiropractor is appalled by this whole situation and even called the workers compensation people. It looks like Starbucks is actually trying to not pay me for the time I need to heal after there fridge door, I had expressed to the SM we needed new fridges as the shelves collapse all the time, broke and hit me. Anyone know a good lawyer 😂

Same. I kind of want to call HR and complain about my SM, he makes a lot of inappropriate jokes, and shift lead who where joking about it. Like I don’t find it funny to have a metal door in my chiropractors words “Possibly injure me for life and cause a curvature in my spine”

I’ve decided not to after talking to my mom, she worked in HR for 10 years. She said nothing will happen unless the other manager who heard it also tells HR. She said all most likely be label a complainer and they’ll put a note in my file in move on. Good to know the people who are there to protect us most likely won’t

You can use sick time for any shift you missed because of this.

Getting workers comp for this can depend on you getting a doctor to declare you temporarily disabled. Once you have a doctors note saying that then it forces their hand to take it more seriously.

I would also follow up with a partner resources complaint about your SM and DM for not taking partner safety seriously.

It’s already been declared a workers compensation case they’re just trying to pay for as little as possible and putting me through hoops. The first guy they assigned to my case went on vacation the next day.

Also they’re trying to tell me that waiting period is normal. It is not and you can fight it! My dad has worked in the service industry in Oregon for 17 years and gotten workers compensation 5 times. He told me that waiting period showed up about 5 years ago and if you push enough you can get paid for those days

The waiting period is absolutely normal and it’s state law. You can look it up. It also varies by state and you get paid for those days once you pass the retroactive period. It has nothing to do with complaining enough. You clearly have no idea what you’re talking about.

Workers comp laws vary by state. This includes the waiting period length and who decides which doctors you see. Experience in one state will not be the exact experience in another.
