went to put in my two weeks, had it all folded up in my hands so my sm couldn't see it and here's how it went

me: "hey (sm) can I talk to u in the back for a sec?"
sm: "just give it to me"
me: "what?"
sm: "just give it to me already" *snatches it out of my hands*
me: "wow okay"
sm: "there's no reason for us to talk either" *leaves*

so there's been a bit of a mass exodus from our store because of him and the fact that he wouldn't even let me speak to him made me not even want to put in my two weeks and just quit on the day. he's currently ignoring sexual harassment and hr won't do anything about it. he also fired a shift instead of letting her finish her two weeks so she won't be paid for her >100 hours sick time and she is already working at a tarbux so she can't file for unemployment. this man also told me my medical issues weren't real and continues to put me on bar 1 for an 8 hour shift and "forgets" to give tens and lunches. i don't even know what to do anymore because he's moving to another store in another state in a month. please help us get him the shit he deserves.

UPDATE: my sm changed all my shifts to when i specifically do not have availability (IM IN COLLEGE AND HAVE CLASSES WTF) so im turning in my resignation today. i know that's what he wants to happen and it pisses me off that i can't work out my next week but it's whatever i guess

yeah not giving breaks and ignoring needed accomodations if you have a doctor's note is illegal and should go to corporate/hr

i wouldn’t even return for my last two weeks. sounds like he is getting exactly what he deserves, maybe you can call partner care or your DM before he moves and its too late. :(

Depends on where you are. There are no federal laws requiring employees to have breaks. If your state doesn't impose their own regulations, there are no "labor laws" to break concerning breaks.

It might take EVERYONE THAT QUIT for Corporate to notice but the right move is for every single person to call. The wrong move, but still effective, is for everyone to not show up to work, ever again. But then you wouldn’t have a job and definitely not at Starbucks.

We have a similar situation, though not as severe, going on at my store. Someone that didn't deserve to be fired was let go and they sent multiple emails to our district manager. Fast forward to today and they have spoken to all of the shifts about the SM and will have a meeting soon with them. Assuming your DM takes their job seriously you could take this route and try to be persistent. Chances are, if what you say is true, corporate has already noticed a lot of the red flags popping up at your store. Good luck and I'm sorry on behalf of your manager.

If you can, keep going up or spread your complaint. Your regional manager might be able to help, other dm's in the area might feel sympathy for you and your team. PCC could help. Any corporation should take sexual harassment extremely seriously. These two people seem disgustingly corrupt, don't let them think they have all the power!

If he’s skipping breaks that is a huge policy violation and should be reported. Ethics and compliance absolutely takes harassment case seriously, I’ve been aware of a couple that they handled. As for the shift, sick pay doesn’t get paid out if you quit and you can’t file for unemployment if you quit either, only if you’re laid off. I’m sure there’s a leadership issue that should be addressed but the right issues need to be addressed and brought to the attention of the appropriate people for something to change.

Yeah i would've walked out. If your dm hasn't been doing anything about this behavior, you guys should've already been going higher than that. Ethics and compliance, your regional manager...
I would still call and report this. It's 100% illegal to not give you a lunch. Is he taking the 30 minutes out of your check anyways? Cuz that's time theft and that should be enough to get him fired.
And you don't get your sick time paid out, unfortunately.

no he isn't taking the time away, he just refuses to give lunches to certain employees. this has only started recently tho, maybe about two weeks

It's not federally illegal to not have breaks, but it could be illegal depending on the state. Agreed on the time theft though.

You're correct, but there's a lot of misconceptions that there's a *law* in the US that requires breaks, and companies/managers that don't have breaks are doing something *illegal.* Which they are often not. It's absolutely policy, and worth causing a fuss about. But it's not *illegal*, and it's important to know the distinction.

Starbucks has a corporate policy on breaks. The only time it isn't followed is if state laws are STRICTER than the company. Everyone at a corporate store gets breaks and lunches. The timing will depend on state laws, but again, if your state sucks and doesn't require them, Starbucks as a company still does. Hope that helps.

If you have a medical condition you have to call PCC and file for an accommodation.

Then when your manager doesn’t honor you or fires you, you sue the fuck out of them and get a nice payday.

So, my advice is go to your Dm, if your Dm isn't gonna listen, go over their head and reach out to the RM.

Starbucks was like my first baby job, and my first week I had issues with a shift of mine...

My first week our District Manager reached out to me, to talk to me about this person's behavior, and it took awhile, but the shift did end up eventually getting fired because of his behavior. That interaction is what made me confident in my future careers with talking to management, usually they are understanding and they do want to help. They are all human too.

Sounds like a lot is going on with your situation and I’m sorry to hear that. Other partners may have better ideas on how to handle all that but it might please you to know that as an “at will employee” you technically don’t have to give a two weeks notice, it’s more of a courtesy than a requirement (if you’re not on salary, that is). I say you just dip the hell out and leave em to handle the understaffed- mess they made. Disposable employees means disposable employers too. You don’t owe them shit.

I hope something good comes out of this. It sucks when crappy management goes wild with power and no one will stop them. You and the baristas at your store deserve so much better than that. I hope things get sorted out, sexual harassment especially. Good luck to whatever job you get next! Hopefully it’s much better!
