I’m a partner who just looked at all edited punches in the partner hours app. I approved them because I wasn’t paying attention, but it looks like I had over 100 edited punches made by my manager to make it look like my shifts had gone exactly as it had been scheduled. This would be fine, except I regularly stay longer to close correctly and clean up after prior shifts because we’re threatened with disciplinary action if we don’t finish closing tasks. However, we’re also threatened with disciplinary action if we don’t get out on time. This is hard because I’ve been getting in trouble for staying late, and now I found out I’m probably not even getting paid for it. Can I continue getting in trouble for staying late if my manager is editing my punches to make it seem like I got out on time?

If she's editing your punches so you don't get paid for the time you stay-- I'm no.big city lawyer but that sounds VERY illegal, you should probably talk to someone about it

This is the thing that nailed one of my old managers. As far as I could see nobody cares when I reported the discrimination, verbal abuse, or literal physical abuse until I also reported edited punch logs, pre our current tools to track it.

Having your manager edit your hours to reflect less hours than you actually worked is illegal.
Call your local department of labor (unless you live in Florida which doesn’t have one) and report this. They take this kind of stuff very seriously.
Fuck calling corporate. Don’t call them, don’t even let them know it’s coming. Get your evidence and then call the state. HR is meant to protect the company NOT you.

This is very illegal. Contact a labor lawyer, not corporate. They have free consultations. You are entitled to triple the amount of wage theft and your attorney's fees. If they are doing it to you, they are doing it to others.

Definitely contact partner resources. Question, are you punching in and out in the system or writing your times on the punch communication log? Or are you not doing either and your SM is punching your time as leaving on time? Don’t forget the punch communication log that you and your SM initial is a legal document stating you are both agreeing to the time written there. Now, if you are clocking out digitally and your SM is going back in there and changing your time, it will show. Start keeping track of this. Screenshot and save everything.

I’m clocking in and out digitally every single time except for I think once in the past four months when I had to get product from another store before my shift. I’m not super worried about the clock in times, but I’m a closer and it seems like the most edits were made for my clock outs. Even fifteen extra minutes multiplied 115 times makes for a lot of extra money and a lot of extra mental strain. I talked to PCC and ethics and compliance and it seems like there will be a trail (I really should not have approved them. I just didn’t pay attention)

Well, that's ridiculous. You're being given contradictory instructions. "Do all tasks." "Clock out at scheduled time." Sometimes both those things can't be done. Tell your district manager that your manager is editing your punches with false edits. Tell your district manager that you're being told to both complete all tasks and to clock out exactly on time and that you're unable to do both those things. Your district manager is going to have to choose one of those instructions to prioritize over the other. Mention that you acknowledged the edits previously but didn't understand at the time what you were doing.

Typical corporate stuff honestly, we're also told "connect with every customer", "keep drive times under 35 seconds", "we respect your availability and don't schedule clopens", and "what, you can't work Sundays? Well we need you, and also 8 hours between shifts isn't technically a clopen so yeah you gotta do it."

I’ve been noticing a lot of edited punches as well. It’s been making me really suspicious, especially since I’m working like 27-29 hr/wk and it seems like I’m getting paid almost the same as when I was working 8-10hr/wk.

My manager will edit punches in the system, but the time reflects actual time worked. They have to code hours to a specific thing, like coverage, non-coverage, and training. I always double check my times before approving anything and it never seems off.

Not getting paid for the hours you worked is wage theft and you can sue over that. Whether or not you finished the tasks by the time you had been scheduled doesn’t matter since in most places you don’t owe the business more then your scheduled.

I had this issue with Starbucks which is why I left. Get someone's attention immediately about that and make sure you get paid and tell them if they don't want you staying late they need to be properly staffed and have reasonable expectations.

It’s not a phone app unfortunately, it was on the back of house computer. You can also see your hours on your phone though, you can access the teamworks webpage for your schedule on any internet device but I don’t think you can do all of the stuff you can on a store computer.
