No breaks for YOU! (self.starbucksbaristas)
submitted by ggoldensunsetss
Okay so this will be a smallish rant. But I’m so fed up with not getting my breaks especially my tens (which are the only ones we get payed). This has happened to me multiple times and Im sick and tired of it. I’ve been working at SB for 2 years now and it’s happening to me more and more often and I’m so tired of physically having to tell my shift to give me a break because that’s not my fucken job. Okay let me explain; Ive noticed that I get scheduled for 4 hours and 45 minutes and typically you would get a 10 and a lunch but in reality that means that I will only be getting one 10 for the day. It pisses me off when it’s scheduled and Bc we need help they don’t give it to me because it’s not a “violation”. Also, whenever I do have longer shifts like 6-7 hours I’m supposed to get 2 ten minute breaks a lunch and same with that, I never get my last tens and if I do it’s because I’ve told my shift and they give it to me when I’m 30 minutes away from leaving. I just think it’s so unfair and I’m wondering if that’s okay??? Like why can’t we just staff people accordingly? Also am I fucken invisible to then?? ITS JUST SO FRUSTRATING!

it's definitely not okay if you're not getting the breaks you're supposed to. you should report it. but correct me if i'm wrong i don't think you get a 30 for working 4 hrs 45 mins? you get one 10 if you work less than 6 hours. you only get a 30 and a 10 if you're working 6 hours and you only get two 10s and a 30 if you're working 8.

idk if your store prints out the daily schedule but it shows who gets what breaks and i would make sure you double check it. if they're not giving you the breaks you need take a pic of the schedule that shows the breaks you should be getting and report your store

wasn’t sure but today my shift was from 1:15 to 6pm and I only got 1 ten and that was 3 hours into my shift (I was scheduled for a lunch)
happybowlita83 18 points 1y ago
You technically don't need a lunch since you worked under 5 hours, and the ssv just might assume you dont want a lunch and would prefer to get paid the time or they dont have enough staff/time to give you your lunch and they just make sure you don't meal break... id honeslty talk to your manager about not getting scheduled over 4.75hrs if you've been meal breaking and not getting paid for it.
happybowlita83 8 points 1y ago
Also i think if you go without a 10 and you let your sm know they pay you an hour or something like that... can't really remember, but I 100% suggest you speak to your sm or dm if you prefer about the recurring issue sometimes they don't catch onto these little things if no one says anything and they might have alot on their plate.
DaybreakNightfall 6 points 1y ago
Wait, how old are you? I only get a lunch if I work 6 or more hours... but I'm not a minor.
thepoopbathroom 2 points 1y ago
In my state, we get a lunch if we work 5 hours. I’m in Kentucky. My bf works at target and it’s the same way
happybowlita83 2 points 1y ago
In my twenties, are you in california? I know it can vary by state... and I think by law they're only required to give us a lunch if you work 6 hohrs but sbux policy is 5 to be on the safe side that someone doesn't go without their lunch break, but dont quote me on that lol
TheFriendlyFeminist 1 points 1y ago
Sbux policy is not 5, it varies. It is 6 at my store.

Don’t skip your breaks. If you are forced to skip your breaks, document and report it every single time it happens. If your state mandates breaks, look into filing a complaint with the labor board, too. If you haven’t been documenting, start today or tomorrow or whenever you work next.

Don’t skip your breaks. You agreed to do a job in exchange for pay and benefits. One of those benefits is your breaks. It is not your problem if there are not enough partners on the floor to cover breaks - don’t skip your breaks. Your SM, DM, corporate - it’s their problem to figure out how to cover breaks.

Don’t skip your breaks. And document, document, document.

Those 10s are paid breaks, and if you don’t get them the bux has affectively withheld 10 minutes worth of wages from you. Starbucks has been sued more than once on paid breaks and has had to pay back partners for it.

Document EVERY shift you’ve not been given a 10 when you were entitled to one. Even past ones, everyone that you can remember, any claims can be audited via punches.

You were owed these breaks and most states take this kind of thing seriously.

Edit: depending on where you are and how long your shift was, they may have denied you ANOTHER break, so your SM is opening SB to major liability should you and your fellow store staff wised up. Because of that, tread lightly in rectifying this, you might face retribution for not being “a team player.”

You are absolutely invisible to them. They don't schedule enough people because it's cheaper to work you until you snap and then just replace you and do it again to someone else.

Record every missed break. Communicate with your SM about it through their work email, and HR if it continues, so that there's a paper trail.

When you work under 5 hours you get a 10, 5-6hours is a lunch (in Cali) and a 10, more than 6 hours you get a lunch and 2 10min breaks.

I work in SC, which has hardly any labor laws at all (I could work someone 8+ hours with no break and not be in violation of state law at all), but if I didn’t send my partners on their breaks I’d be in huge trouble. It’s not even dependent on your state laws, breaks are a Starbucks policy. I would definitely get PRC involved after speaking with your SM/DM (if those convos don’t go anywhere), and the labor laws are just a bonus if your state actually has them.
And short staffing is no excuse. I was at a cafe store until last week and I’ve literally had to run the floor BY MYSELF for 10 minutes to send my partners on breaks if that’s what it took. It’s the SSVs shortfall, not yours.
FfierceLaw 3 points 1y ago
You have to ask. In my store, my SSVs thank us and apologize if we're well into the second half of our shifts and have to ask, they're just human, they will forget. Often when new partners come in a shift who's on the ball will have that person start giving breaks when they clock in. It just sounds like your SSVs are minimally competent. They may not be taking their own breaks. Doesn't matter, you get yours
TheFriendlyFeminist 2 points 1y ago
It could vary depending on your state, but in mine (NY), for any shift under 6 hours, you would only get 1 ten minute break. Anything in between 6-6.5 hours gets your 1 ten and 1 thirty. Anything over 6.5 gets you 2 tens and a 30. So reading your situation I don’t think you’re actually being shorted at all.
LesbiPlayin 2 points 1y ago
I would check your state laws regarding paid breaks. I live in California and I know that if you live here you are entitled to your breaks which means your employer must give them to you unless you explicitly say you do not want to take them that day. If you live else where I would double check your state laws and even your company policy for your area. Point it out to them if they go against the law/policy and tell them they would be breaching something if they refused to follow those rules.
emosweatshirt 2 points 1y ago
don’t ask anymore. you are entitled to your breaks. “im going on my 10 now, ive worked *this long* and i need a break” and go. call partner care, submit a formal complaint to your manager, but don’t continue this cycle. its not ok and your ssvs should be giving out breaks properly.
shikiP 1 points 1y ago
I may have my problems with LS but im glad we are unionized. You guys need a break. I wish there was a union for corp baristas because its insane they are taking your breaks.
Wonderland-2941 1 points 1y ago
I’m an SSV and how I run my breaks is that I usually follow the DCR pretty much spot on. It will typically give the scheduled person a break every 2 hours. So if you work 4.75 hours I would give you a 10 minute break 2 hours into your shift and that would be it. In TN, if you are over 18 and work less than 6 hrs you only get one 10 min break. If you are a minor and work 4-5 hours you are scheduled a lunch and a 10 min break. If you work over 6 hours everyone is scheduled a first 10, a lunch and a last 10.
baristabiitch 1 points 1y ago
I’m in the same boat, everyone is like “document and complain” and I don’t feel like taking the time or energy or cause issues
darkwolf523 1 points 1y ago
Sounds like this is reportable. But yeah I would report that to your DM
