Being denied my 10s and wondering what to do... (self.starbucksbaristas)

Hey y'all! I just started at a new starbucks in Oklahoma, and I have an assistant store manager who regularly says she only gives one ten when we're busy... I've never seen her give two tens, even for 8hr shifts. What can I do about this? I don't want to make a huge stink, but I'm also not comfortable working without my breaks. Can I report it anonymously? Or should I try to transfer stores?

EDIT TO UPDATE! I talked to my store manager today and she was a bit defensive saying she'd look into it and talk to the district manager, but that this was an area-wide practice to consider second 10s optional. I said okayyyy but in the manual it says they're not... And she said she'd look into it. She texted me less than 10min after I left saying she'd found that they are required and that she'd talk to all of our shift managers today!! WOO! Stand up for yourselves y'all, sometimes your managers are just silly and don't realize what they're doing is wrong :)

The shifts at my store make sure everyone gets the breaks they are scheduled no matter what. We're a very busy store and we have been very short staffed. They have no excuse not to give you your 10s. I'd say something about it and if nothing changes go above them until someone does something. Document everything.

Yes! This was how much old store in Boston was. This new store I'm at is high volume for the area, but it is only ~70-75 orders at peak, my old store regularly hit 100. Like if we could have our breaks there I'm sure we can here too

God that's so fucked up lol. I would somehow report it anonymously and then transfer. There's a partner resource number somewhere. If all else fails, tell your DM

People talk about transferring like it's easy. DM's really don't care about you enough to look into the details of why you want to transfer and then approve it.

All of this is with no lunch??!? Talk to the store manager, you don’t have to name names u can just be like “what’s the break policy again? I’m having a hard time working with no breaks”. if that doesn’t work u can take it up with ur DM but I’m pretty you won’t have to take it that far

Oh I get a lunch! But on an 8hr shift you're supposed to get 30min lunch and two tens - I only get the meal and one ten.

Had this happen at my last store. Another shift even got upset with me for giving the breaks and lunches as scheduled. If it is on the schedule it should be honored. Starbucks expects you to be on time for your shift when scheduled, you should expect to get your breaks and lunches as scheduled. Schedule adherence runs both ways.

Hey! I just found this quote in our handbook incase you want to bring it up with your manager :) it is on page 15 of the physical guide!

"All nonexempt partners (cafe attendants, baristas, shift supervisors, shift managers, assisted store managers, and California store managers) are required to take scheduled meal and rest breaks. Under no circumstances may a nonexempt partner perform work during the meal or rest break, or end the break early to resume work."

If you google Starbucks ethics and compliance you will find how to to report it to Starbucks. You may also want to report to local labor department as well, as it’s not just Starbucks rules it is likely state law as well.

Unfortunately Oklahoma work laws are trash, so they only require the 30min unpaid lunch break :( but I'm definitely figuring out how to report it to Starbucks! OK also only requires a minimum wage of $7.25, but Starbucks promises higher - they can't promise one thing and deliver on the bare minimum

I remember someone posting that Starbucks has a more strict set of rules for breaks, and they honor whichever is stricter, the local law or their own policy. Hopefully that’s true and the ethics and compliance can help

It looks like Oklahoma doesn’t really require breaks at all, just that if you get a rest break it has to be paid and a meal is usually 30 minutes or longer that goes unpaid. This makes it a lot harder to do something because it’s just company policy and the dm might choose to not care. It would be easier in California for example, because they require a 30 minute lunch in the first 5 hours of the shift if they work more than 5 hours in the day, and rest breaks are required for non-exempt employees (us) where they need a 10 if they work more than 3 ½ hours in and day and are entitled to a ten for every four hours, or substantial fraction of that that they work in a day. In that case, it would be pretty to easy to sue the company especially if you were able to document that you never got your second 10, and would make the dm more likely to care since you can sue the company. Honestly you’ll have to talk to your dm and hope they care.

Although I personally believe everyone should be entitled to all of their scheduled breaks, iirc the second ten is optional according to company policy (unless state law mandates it, which most states do not afaik) and so there isn’t really much you can do. It sucks ass and I’m sorry you have to deal with that. Most of the managers at my store prioritize breaks

In the newest edition of the partner handbook, it says "The number of rest breaks will depend on the length of the shift. Generally, one 10-minute rest break will be provided for every four hours (or major fraction thereof) worked. Partners do not need to push in or out for rest breaks" so that means every 4 hours you work, you get 1 ten, and if you work 2-4hrs on top of that you get two tens. So 8 hours is 2 tens, 6 hours is 2 tens, 5 hours is only one ten. Meals are calculated separately and you get those anytime you work over 6hr!

Oof I was always told ten minute breaks are entirely optional. I wonder if that changed at some point? I was in Texas when I was being told that though so that makes sense.

Haha yeah, equally shit work laws. But starbucks can't just pick and choose when it follows it's OWN POLICIES! Shit if we could do that I'd just lock the store whenever it was too busy - there is no law saying we HAVE to be open, it is just a store policy :)

Well it would have depended on the wording of the policy but this does say that it shouldn’t happen. I always was just told I could skip tens if I needed to and that was a judgement call.

Have you asked her directly about it? When I was a shift, I rarely ever initiated second tens unless we were really slow, as most of my partners preferred to just work through the rest of their shift, but I made it clear that anyone could take it if they wanted because it was theirs to take.

Yeah I have, she specifically told me no... Even tho when I got back from my ten there were baristas playing hangman because it was so slow...

Okay I was kind of wondering if I should feel sympathetic to the ASM up until reading this because sometimes, at least on closing shifts, second tens can be really obnoxious to give (even if I always try to do it, don’t get me wrong) but yeah if you’re slow enough people are playing games that isn’t going to be hard to do. They’re basically on break as it is, albeit informally.

Right! I didn't get my 10s during my training shifts (I'm a returning barista, but I was gone for 2 years so I went through the full training), but I didn't mind because so much of it was relaxed stuff on the iPads. Totally informal breaks. But, like, on a real shift just give us our real breaks!

Tens are not guaranteed. I would report it if I were you because while they're not guaranteed, they're supposed to be given unless they're so inconvenient they're not really possible. And that rarely happens at my store. I also wouldn't worry about whether or not your report is anonymous. I have reported so many things and not one of them were anonymous. Did I get some pushback sometimes? Yes. But I don't care. I'm not gonna keep my mouth shut out of fear of retaliation. The only things I report are big deals, so any pushback I got was nonsense anyway. The best way to report something is to go to the immediate superior. In this case, it looks like it would be your store manager.

One of the reasons I recommend not prioritizing anonymity is it's going to save time to simply report directly to the person who needs to know the information. I don't want to talk to some stranger in Seattle or whatever about something my shift supervisor did and then hope that they contact my manager and relay the information. Can you imagine if every complaint every barista made was to that department? It couldn't possibly handle them all.

Another factor is that retaliation is not allowed at Starbucks. Of course, that doesn't mean it couldn't possibly happen, but I feel safe voicing my concerns with my own voice in my own workplace. And I kind of like the idea of having my name attached to them because it shows how much I care.

But this is all my opinion, and you'll know better than I the details of your situation and therefore what type of report is more appropriate for it.

They are guaranteed for a long enough shift, according to the partner handbook. Companies can enforce stricter policies (so more guaranteed breaks) than state laws, as long as it doesn’t break them. However, it’s much harder to do something about when state law doesn’t require breaks because dms and sms might not care about it.

I would look up the partner handbook and find where it says it as well to show her, so she can’t deny it and then you would know if it’s with malicious intent.
