I was working window and was being pleasant , and I saw a customers friend recording the whole time?! It made me uncomfortable and while I was waiting on the food items I just went to the back so I wouldn’t be in view. It made me feel really uncomfortable and I was wondering if this is allowed ?! Also what do I say to them if they do it again ? I open and 1) look a mess in the morning and 2) just don’t want to be in anyone’s videos I didn’t consent to. Thanks so much appreciate any help

You can deny service if they refuse to stop recording. Advocate for yourself. There IS a customer code of conduct. I would shut the window and get a shift. Then I (the shift) shooould walk over and say something like "recording my baristas without consent is extremely disrespectful and not funny at all. Please stop and delete it or we will not be able to serve you today"

I wouldn’t trust them to delete it since it could just be recovered from “recently deleted” or they could have iCloud storage that backs up everything they record or take pictures of. If it were up to me I’d just tell them to leave.

I’ve asked people not to record me, usually it’s super polite like “hey there! I’m really uncomfortable with being recorded, can we not do that please?” If they push it I’ll make it awkward. “Look, I’m not trying to be rude, but I had to fight so hard to keep a dangerous family member from finding me, and your recording could mess that all up and I would be in danger. Human to human, can you not?” Usually makes them stop. And is pretty true.

they're not. they're just saying they won't support you if you don't do exactly as they say ;) no but really. i don't know how this would play out in reality and hope i don't learn, but it would likely really boil down to in sore leadership (manager) to support you. most of us don't want to be filmed as we work, i would think? so i would hope there would be that backing up in setting that boundary. but who knows :/

Standalone Starbucks' are private properties. If it's a drivethru or plaza, you are fully allowed to ask them to stop. If its in a mall, then the rules may differ (since malls are also a form of private property)

I had a similar thing happen a couple of times now. They recorded at the box at first then pulled up and were recording me talking to them but I didn't notice at first and once I did I just stepped away until their items were ready. and then an instant the other day of a girl recording as soon as I handed her the drink. Though it's brief it's still rude. I don't understand why they can't ask permission before hand.

In terms of legality, for most states it is not illegal to record in a private business that serves the public. It can be however against the policy of the store/company and you may be asked to stop or leave.

Uhh, no, it does not. Private property - whether a business, home, or any place in which there is a private owner of said property - belongs to the owner and as such, they are allowed to set rules for photo/video capture while on/in their premisis. If access to the property can be revoked by the owner, then that is NOT "being in public." And access to Starbucks can be revoked at anytime by the owner or anyone designated to oversee the property and uphold the rules and policies of it.

Starbucks policy on filming is really open for misinterpretation. Basically this can boil down to a possible Starbucks policy violation but not illegal. Which means the customer could be asked to leave but can't be compelled to delete the video. However if they really wanted to film they can just do so from public property as that is legal everywhere in the US.

I think depending on which state you’re in, there is a law against like audio recording someone else unless they give consent and if they used a phone which probably means they have audio and you weren’t a willing participant, it’s illegal. I could be wrong though.

Soo not really seeing a lot of info here but it’s actually against policy for anyone to film inside the store or take pictures of videos they drive thru of what’s happening behind bar. You can absolutely ask them to stop and tell them they are not allowed to film without permission.

We had issues with people doing that and we just told them they are on private property and it is illegal to take a video of us on private property without our consent and if they continue we can report them or refuse service

It’s probably someone making a vlog, I see it all the time on TikTok or YouTube where the person just records them getting the food they ordered by the worker. Sometimes they have a friend record, sometimes it’s just their hidden camera. I think most workers either ignore it or not see it judging by reactions. But I’ve seen workers look weirded out before.
But I get it makes you uncomfortable, but chances are you’re a background character for their video
