Sounds Ike your manager is a mess. I've never heard of people wanting to opt out of breaks, but even so, nobody should assume that's what YOU want. It should be something you're asked, and then you give your answer to decide it. They legally have to give you breaks, and so forcing you not to take one is definitely a violation.

Yea, she gave me a ten and I noticed people who had 6 hr shifts got lunches. im in a state where 5 hr warrants a lunch. She didn't even acknowledge that she should have gave me a lunch; she just told me that bs so im really annoyed already

I'd try to talk to her about it. I know it's not fun, I absolutely dread talking to my SM. But if you try to be civil and explain that you want to take your lunches and not skip them, hopefully she'll give them to you next shift. If she doesn't, then you start reporting it above her. Anyways, welcome back to the company :)

She did ask me when I started today and wanted to make sure that we resolved it so i’m chill for now

I’m in CA and that’s how we run 5 hours shifts also. You clock out 5-10 min early instead of taking a lunch.
Collegecakes1 points1y ago
Yes, I agree with you that this is an valid option, but she never discussed this with me until after the fact
Roarkshop1 points1y ago
Yeah I always opted for this. Since we have to clock out for lunches I would just rather leave and eat at home than sit in the store for thirty minutes without getting paid. But the lunch is your right and if you want to take it you should!

Part of me says i’m being over dramatic, however the 2 year partner in me says no.
Collegecakes2 points1y ago
Edit: Issue resolved for now.. She made sure to ask if I wanted the lunch or to leave early today
LegendOfJakelope1 points1y ago
Yeah, even if that's how most people do their shifts- clocking out early- you never explicitly said that's what you wanted. I feel like an SM not being able to own up to the miscommunication is a small red flag. Not really quit worthy unless you get more hours at your other job, but def something to keep in mind..... best of luck to you OP.

A lot of the time when I’m scheduled for a 5hr they’ll have me leave a couple minutes early, we’re not paid for lunches so it doesn’t bother me lol. I also work through most of my tens (as a barista) because it’s not marked on the system.
