Edited punches (self.starbucksbaristas)
submitted by Individual_Hand783
I had a punch that my manger edited to 12pm instead of the time I clocked out at 12:30pm and it is listed as “punch edited per schedule.” What happens if I dispute it?
SunBusiness8291 252 points 1y ago
You should dispute it. She is stealing your time and should be reported for it.
wanderer1522 167 points 1y ago
Yeah definitely dispute that, you're not working for fun, you're working to get payed. And I'm pretty sure changing your punch like that is actually illegal.

Wage theft

You should show up late and ask them to adjust it "per schedule"
jazzysoranio 60 points 1y ago
Yeah, I bet they’re shaving hours because either you went into overtime and they could get in trouble or labor went over and they’re already on thin ice with the DM so they did that hoping you wouldn’t notice. It’s not right.

Step 1: Screenshot your schedule from that day, as well as any snaps or photos you may have taken on shift near or at the time you clocked out (to prove you were there). Screenshot the time adjustment as well.

Step 2: (*ONLY if you feel comfortable. Skip if not*) Mention it to your SM and ask what the hell? Ask for a readjustment in your favor. If they say no or pretend it didn't happen, ignore them, play it off, and get ready to move up the ladder. This was only a courtesy to your SM because you have to see their face at work often, and they have direct means to fuck with your job status. Don't press it. Don't argue. They're digging their own grave at this point and will not last much longer at the bux after you get to the next steps.

Step 3: Contact the Partner Contact Center. Tell them you have a payroll issue and that you'd like to speak to someone internally. This is important verbiage to use: "Before I call the Department of Labor, I was hoping we could figure out this problem internally to get me adequately paid for my time on the clock." They likely won't protest and will fix your problem from here to save their own asses, but let's pretend they do give you a hard time. What would you do next?

Step 4: Contact 3-5 lawyers near you. It is important to ask for someone that can help you with a labor dispute, and that you're looking to make a formal complaint to the US Dept of Labor. Many lawyers love these cases because they know there will be a payout, especially when the client has receipts (screenshots from step 1). Pick the lawyer that is willing to work on contingency. This means the lawyer service will be free for you because the lawyer would be paid out of your winnings. If you make it to this step, consider asking for payment for this time it's taken you to consult Reddit, call lawyers, and deal with something that shouldn't have happened to you. Consider "pain and suffering" as well, because retaliation is a realistic expectation to prepare for.

Step 5: Listen to the lawyer from here. Things vary state by state, and this is as far as my knowledge goes on the subject.

Step 6: If you're willing, able, and ready, you can start working towards unionizing your store! $1 is a nice link about how to get started with this if you're interested. Together, we bargain. Divided, we beg.

I'm sorry this happened to you. I hope it works out!

Excellent, excellent advice.

Take photos/screenshots first where it shows the edit (and ideally your original time; I think they instated a new time system since I left so idk what it shows.) Then dispute the punch. I would also check and make sure none of your other punches were edited without you noticing. Any manager willing to steal time once is willing to steal time repeatedly.

This is something that can be reported (check on your state's DOL website for more information), but you need to have all your documentation in order before you do so. Some states also require you to formally request the wages you are owed before you report to them; filing a dispute and following up with your manager should qualify for that.

This has happened to me recently, how do I dispute it??
Individual_Hand783 [OP] 24 points 1y ago
I have the mobile app for scheduling and it’s available on there!
sh0werrod 6 points 1y ago
Tysm!!
SelectAioli 5 points 1y ago
there’s a mobile app for scheduling??
sh0werrod 2 points 1y ago
Yeah! In the back there should be a poster walking you through how to download it. It’s a really long process tbh, I’d definitely ask a manager/shift to help out. It’s a great app tho, you can request time off and change availability at any time

Call the department of labor and report your store location for wage theft. The store records need to be audited so that everyone gets paid for worked hours
rv49er 16 points 1y ago
This is wage theft. Depending on the state, call a lawyer or the state. Do not contact HR. They are not there to help.
RaptorClaw27 9 points 1y ago
HR is there to protect the company. This manager is more of a threat to the company than this hourly employee, so they are exactly there to help OP.
Consistent_Ask_3963 10 points 1y ago
Dispute it and I agree about reporting it!!
dogsofwintergaming 5 points 1y ago
You get paid for the time you worked and the money you deserve and your manager gets separated for time card manipulation. Just make sure it wasn't an honest mistake, as in make sure you actually did punch and/or write in the book.

I’d just ask them?
syddsmiles1024 2 points 1y ago
Yeah my sm thought i missed a punch bc I normally work princess shifts and a shift asked me to stay and cover
taytertotz 2 points 1y ago
I love a good princess shift! Glad it worked out!
Dr_mombie 2 points 1y ago
That's wage theft and should be reported to the department of labor. If she's doing it to you, she is doing it to everyone and the records need to be audited going waaaayyyy the fuck back. You and many others may be owed a shit load of back pay.
Bogie1Kanobi 2 points 1y ago
There’s a camera that shows when you entered I’ll assume. That’s payroll fraud and an easy way to terminate the person. Unless they are liked, then it will be swept under the rug.

Lots of rug sweeping nowadays. It used to be because of nepotism and favoritism now it’s just a matter of survival. Hard to keep people in management roles for very long pre pandemic. Now I see lots of people get away with things that 5-10 years ago they would be termed or managed out with ease.

You could just go them and say hey, “I don’t want to cause problems or drama but I was not payed properly for the date of *.

Being silent is the wrong move.
ItzBoogieMan 2 points 1y ago
You can literally get her fired for this, if you have evidence, take it up HR.
Anxiousurca 2 points 1y ago
you should definitely dispute that because even though you may have been scheduled for 12p end, one thing led to another and you worked an extra 30 minutes. Regardless of if you were supposed to do that, you are owed pay for that 30 minutes. Time theft works in both directions.
LatterRooster 1 points 1y ago
Say something first in writing. Like text.
Snarkybratt 1 points 1y ago
I’d agree that having written evidence of conversations about the incident(s) can only strengthen your case! Whenever possible GET IT IN WRITING, because it’s harder to dispute!
sheenhowell 1 points 1y ago
Holy shit that is straight-up theft. That's money out of your paycheck. if you're in the US i would bet that it would be an easy day in court to say "big corperation stole my money" and they have the funds to just pay you to not talk about it anymore. Depends how much you like your SM though bc that's grounds for termination as far as I know
hopelovepeace33 1 points 1y ago
Dispute that, she’s stealing 30 minutes of your time which you should be paid for.
