lol no. federal law does not require a meal break or short 10 minute breaks. also, i’m in pennsylvania and they also do not require meal or short breaks. 30 minute meals are starbucks policy and are required to be offered when working more than 6 hours. the 10 minute breaks are not required. You’d think they’d be law wouldn’t you.

yeah you’re right and i think washington state has very similar laws which explains the method of how they offer and schedule breaks/meals in the DCR

Meal breaks are for sure required in Oregon. Source? I live there and work a second job. Starbucks goes by Washington labor laws I think. I’m pretty sure cause i started at 17 with the company and Oregon child labor laws are not as strict as Washington. And the laws that are followed are pretty strict at Starbucks.

Yeah, I know in Kentucky we have a labor law poster and we are guaranteed a 10 if we work more than 4 hours, and at five we have a state mandated lunch, our second ten is only rightfully given to us if it is 3 hours after our 30

My shifts have always asked me when I'm walking the line on a lunch. If I stay late qnd end up at like 6 hours I'm always asked if I want to have a lunch or two fifteens so I can stay on the clock. If I'm given a choice I don't really see a problem but just saying that nobody is entitled to a break and they should be grateful to get one is....interesting

as much as you don’t wanna screw over your coworkers you deserve your breaks and they are required by law. in illinois at least: 6 hours is a 10, 7 hours is two 10’s and 8 is two 10’s and a lunch.
breaks are not a courtesy they should be encouraged and followed. this is what i have been told since day one. personally, a reasonable shift/employer would see this and avoid burnouts with diligent breaks. my shift will straight up tell me to get off the floor because any more time and the breaks get pushed back and then they don’t get theirs. everyone should get it including the shift.

Haha I was in a pretty bad car accident, took no days off(I was on “vacation” when I was hit so my time off request covered just enough time for me to figure out how to get home!) Never went to the doctor (minus an ER visit the day after to make sure there were no internal injuries) I only had whiplash and I needed money because now I also needed a new car. It’s like a month later and my SSV just. Forgot to send everyone on breaks, except Anne who got 2 smoke breaks since I’d been there. It was like hour 6 and I still hadn’t been able to sit down for 5 minutes and my back was KILLING ME to the point I sat down in the drive thru when it was dead and just cried. Anne started giving me shit for not working hard enough, as if she didn’t have 20 minutes in breaks in her 5 hour shift and I’ve had 0 in my 6 hours. I was then promptly sent on my half. But never any of my 10’s

Im in CA where no breaks is a big deal & where my store manager always emphasizes that partners comes before customers bc no one is asking us to work ourselves to death... i always tell my partners to write in the book that they’ve clicked out 15 minutes from when they should be clocking out (10 minutes here) & they can either sit in the back & take their break or just leave early & still get paid for that time

Also from CA and can confirm that break laws are pretty strict here. All the other jobs I've worked in my life follow the same exact format, for every 4 hrs you get a 10min break If its over 5 hours, you recieve a 30min break. If you work over 8 hours you're supposed to recieve an hour break instead of a 30 min break but i wonder if thats to avoid paying overtime??? Lol

I’m my state (MD) my manager was telling me that there’s no code or law that says employees are entitled to a 15 even if it would be their only break. Her source was our area legal guy. 30s obviously are a must. She doesn’t throw that technicality around tho obviously but if it’s a busy day and I’m supposed get a 15 and a 30 sometimes the 15 gets skipped (this is very rare however.) then like a week later she was on the floor and I was running the shift and I asked her “if she really wanted her 15 today bc I don’t know if I could do it and I’m technically not legally required too” the daggers she shot at me made my day

You wouldn’t get compensated for a break that’s already supposed to be paid. Even if you didn’t get your meal, you’re still paid the time worked.
As for laws, it depends on your state or country. In my state you have a right to breaks, but they aren’t required. I generally skip almost all my breaks to make sure my baristas get theirs and focus on customers, tasks, restocking, cleaning, etc.

I know this isn’t going to be what people want to hear, but if it’s busy, you’ll get better credit with your team for working through it than complaining about an extra break.
As others said though, if it happens often, speak to your shift or manager. If you really want your break, speak up. Tell your shift, hey I know we’re really busy, but I really need my other break. Say you feel light headed or something.

But I’ll be honest. The call-outs and being slammed is going to continue and get worse throughout the holiday season. It’s retail. And retail is hell. You either become hell or leave.

A lot of the times when you're short-staffed and your shift is overwhelmed they may just forget, that's not necessarily something malicious or intentional. It really sucks when you can't get all your breaks, but when I was a new shift it was really hard to keep track of everyone and all of their 10s, some people wouldn't get second 10s (but I always got their firsts and their lunches). I know that's not the question but I feel like I have to defend a little bit.

At my store we do our best to make sure breaks are given but if you don’t get your last 10 whoever is shift at the time will let shift the next day know that you didn’t get your last 10 and will usually get you a 20 along with your other 10 and lunch the next time you work.

it depends on your state. if your state has labor laws then they can get in trouble for not giving you your breaks but you can’t be compensated for it

I haven't had a second 10 in months lol only when my sm is running the floor and it's slow and she's in a good mood. Takes all 3 of those to get second 10s. I wish they weren't even on the schedule because new partners always ask about it and feel scammed.

in CA it’s a labor law so you can contact partner ethics, your DM, the CA labor board, or all 3, but try to get some documentation first. maybe try texting the shift that ran breaks to ask that question and when they say no or we’ll see what we can do or something like that they are basically admitting it happened and that is proof. as long as they don’t outright deny it it should be enough to go from there
