Starbucks policy and termination vs resignation: which is better?(self.starbucksbaristas)
submitted by boy_linda
I'm likely getting fired this week for misconduct and am not sure if it'd be better to quit or let my store manager fire me, as far as adding paid vacation/sick days earned to my final paycheck, having extended health/dental/vision insurance or cobra benefits, room for severance pay (which I doubt they'll offer me but idk what starbucks policy is), etc. I don't have bean stock or, as far as I know, anything in my 401k, so I'm not worried about these. but I'm on the path to getting top surgery, getting my teeth checked for the first time in two years, and getting new glasses since 2018, so losing my job and my benefits will strip me of all of this and idk what options I have to minimize the impact this will have on my health

I'm not sure of the nature of your misconduct, so it might be moot, but if you quit you definitely can't file for unemployment or wrongful termination if either of those are possible. Look into your states laws and maybe talk to a labor lawyer in your state for legal advice. Companies will always try to get you to resign, because it's easier and cheaper for them.

tbh I have no idea if it falls under general or gross misconduct. I can't qualify for unemployment or wrongful termination in my state (nevada) for either type of misconduct as far as I know, but cobra can be used unless I'm fired for gross misconduct.

You can always appeal if they try to deny your unemployment. I would recommend getting actual legal advice though

Well quitting is better. If he/she fires u, u can get red flagged and might not be able to work for Starbucks anymore. If u quit, u can always come back but they might call ur previous Store manager for reference if u have signed any warnings. U should wait a few years before applying again, like wait til she leaves

after this I don't think I have any real interest in working at starbucks again aside for some of the healthcare benefits, I've never felt more unappreciated and angry at a job and while I'm willing to stick it out for now for healthcare (if I even have the opportunity still), I don't see myself returning

Ok but quitting is way better than getting fired

not necessarily if we're talking about eligibility for cobra or medicaid after the fact!!

Theirs never a benefit to the employee for quitting vs. terminated. You have a little more leverage if it’s not your decision. Also, proving misconduct is very difficult, so if you can, say as little as possible and beg for mercy. Otherwise get any of those appointments in before the end of the month, vision and dentist should be somewhat easy. Cobra is a great option of your state doesn’t have an ACA plan to consider. Apply for unemployment, apply for other jobs. Good luck!
