“Working time is for work, so your employer may maintain and enforce non-discriminatory rules limiting solicitation and distribution, except that your employer cannot prohibit you from talking about or soliciting for a union during non-work time, such as before or after work or during break times; or from distributing union literature during non-work time, in non-work areas, such as parking lots or break rooms”
So it appears that they can actually stop you from talking about it during work times, because you’re working. But break and stuff is fine. I honestly feel like if it’s just talk that doesn’t inhibit work any more than regular chatter does it should be fine but according to the link you can be stopped if it’s during work time

HaHa! Interesting how you cut off the last sentence of the “blurb” you took that says:
“Also, restrictions on your efforts to communicate with co-workers cannot be discriminatory. For example, your employer cannot prohibit you from talking about the union during working time if it permits you to talk about other non-work-related matters during working time.”

You can get wittten up for talking about non work topics if it inhibitd you from doing your job though.

If a customer comes to the window and says unionize- the customer is initiating conversation, the customer IS our job. so your point in this scenario is invalid

I don’t think it’s against policy to discuss it off work or at work but prob not the best plan to do so at work.
Gh0st_W6lker18 points1y ago
Yeah, they have no right to tell you what to do on your own time
betsylang19 points1y ago
Look to the legally mandated signage aboit unions and you will see that you have a legal right to talk about unions at work, after work and with coworkers at any time. It is literally illegal for sbux to restrict any pro or con union talk by partners.

Yeah I would have just said great idea and kept it moving! I think he was trying to be nice and maybe meant that as in “I hope you guys can get more rights/benefits”? As for ur shift, they are incorrect about policy as another commenter explains.

That's ~illegal~ for your supervisor to say. DMs and SMs are implying it's not allowed without (or sometimes accidentally) actually saying it. The implication being your SSVs should be shutting down that talk.
I'm saying this because I was also given that implication and when another SSV asked if they should monitor for that kind of talk, the response wasn't yes or no, it was a vague response about how it's "uncomfortable" for some and we want a "comfortable" work environment. Unfortunately this can make it easier to scapegoat SSVs for the illegal silencing instead of the corporate goons orchestrating it.

not me, a ssv, discussing unions with my sm after asking if our sister store was unionizing. I think we went on for about 20 minutes on the topic. He believes everyone is just jumping on the trend, and has no understanding of what they are asking for.
HamburgIar_2 points1y ago
He's right
mewwissa1 points1y ago
Like was he trying to be a dick or encouraging y’all? Either way I would’ve said “I can’t respond to that, but I can take your breakfast/ coffee order!” Like stop trying to stir the pot everywhere you go just because you’re old and bored and lonely
coolsexysmartvirgo [OP]2 points1y ago
no no they were saying that to encourage us
mewwissa1 points1y ago
Oh then he gets a free extra shot 🤣🤣🤣🤣

I’d deflect it like any other stupid shit people say in response to that question. (A million dollars, a winning lottery ticket, a nap, a day off work, etc)
“Oh, well, I’ll see what i can do about that, but in the meantime, what are you thinking for drinks today?”
