You need a lawyer, like right now! This is a golden ticket to get a settlement from Sbux. Look into a lawyer that does workman's comp. If you can prove that you got your cyst from that cooler (maybe someone at work agrees), then you're settlement.

You're not going to be charged from your first phone call, and good luck!
kiddo-l 64 points 1y ago
Copper isn’t classified as a carcinogen. And your cyst is very likely non cancerous. Yeah it’s gross to eat copper but corrélation is not causation. If you were experiencing symptoms of copper toxicity on the other hand, then you’d have a case. Assuming you’re going to get a settlement for your cyst is a bonkers, but if you start shitting blue and green take the above advice and collect your $$$
aerkyanite 1 points 1y ago
You're barking into the wrong dog's ear: OP might want to hear this.
microworldunit 49 points 1y ago
I don't think you'd win that case, if they can prove you complained about it being gross while still continuing to willingly consume it. Your customers could probably sue, though.
aerkyanite 10 points 1y ago
Possibly, a first visit to a law office will tell them exactly what case (if any) that they have. Might be good to see who else might have been affected could be advised to provide samples of possibly infected tissue
tjdurl 1 points 1y ago
This is totally not true lol.
KittenG8r 37 points 1y ago
Yes! This! And keep calling until you get an attorney that will take your case. Don’t be dissuaded by nos.
sheep_heavenly 70 points 1y ago
Lawyer up, like yesterday.

Fuck the dismissive way Starbucks handles safety concerns. You said something for months and nobody even had a maintenance call scheduled until now? It's so common.
TransposedApophenia 63 points 1y ago
You need a lawyer, it sounds like yo could very well have a case and others might be at risk as well.
LilKaySigs 56 points 1y ago
Is it a cyst or a tumor because there’s a genuine difference
MsMeggers 6 points 1y ago
Yeah cysts aren't connected to cancer and havign a cyst doesn't increase your risk of cancer.

But that being said, everyone in your store should definitely get a lawyer! You can even do a class action lawsuit against Starbucks, make sure you have proof that you tried to get then to fix it. Text messages, emails, anything.

Edit: Consuming copper can be dangerous for your health, just not cancer-wise. At the same time it is an essential nutrient so it really depends on how much was in the ice. I still think you could get a case on if you were ignored, but again, you would have to have proof

There is absolutely no way you will be able to prove that consuming Starbucks ice gave you a cyst. A cyst is not cancer. Copper is not a carcinogen, anyway. No lawyer in the world will take this on as a case. You need to calm down.

100% agree
TeslaM3Driver 1 points 1y ago
Oh a cheap lawyer that works on an hourly fee and not a contingency fee would take this case without a doubt just to fleece OP out of their money. Hopefully the OP doesn’t take any advice of fellow baristas screaming to get a lawyer. No one here should be giving their opinion on how this could be a huge legal case/settlement, anyone who’s taken an Intro to Law 101 class could tell OP this is literally nothing.
CoffeePleaseQuick 25 points 1y ago
I think something like 1/2 of all women have cysts so that won't be good proof of harm. It's very common and harmless. Some medical professionals believe that coffee and caffeine cause more of them, but that's debated,
TeslaM3Driver 14 points 1y ago
So… you thought there was shit in the ice… and still willingly consumed it the entire time anyways?

Sorry but it isn’t Starbucks fault that you kept eating ice that you thought was bad. Also copper is not considered a carcinogen. So I would recommend calling your doctor and having the cyst biopsied and moving on with your life. And probably stop willingly eating things that you think are bad.

“I work at a grocery store, I kept telling everyone this bread was moldy, but I kept eating it anyways!! Now I’m sick!! Who do I call??” See how little sense you’re making by asking who to call and being angry?
0x52and1x52 14 points 1y ago
Cysts are normal and not caused by ice lol… I have a cyst on my neck that the doctors advised I do not get removed since it is so close to my spinal cord. They’re not even a big deal.
dontgiveah00t 10 points 1y ago
I found pink mold in our ice machine and my ASM said “it was probably nothing”
meganroslv 8 points 1y ago
A cyst isn’t cancer
RaptorClaw27 7 points 1y ago
I'm just going to put this here for everyone to see: no matter what your position in the store is, you can grab an iPad, scan a QR code, and call in something that does not feel right to you. Don't drink copper ice for 8 months without calling it in. If you don't know how to call something in as a barista, all someone else for help. Take initiative to make your workplace better and safer.
thatactorjoe 6 points 1y ago
I mean, this sounds like a lawsuit waiting to happen. I'd say try to find an attorney.
betsylang 5 points 1y ago
My gods! I'm so sorry. Document, document document! Take a pic of the report by the maintenance guy, see if you or anyone else has a Pic of the stuff in the ice. And you're doc reports. Encourage all your coworkers to seek medical care immediately!
Also if you're sick I suspect customers might be sick as well. When you talk to a lawyer include the concern for your coworkers and customers.
GuySmileyIncognito 5 points 1y ago
This is extreme obviously, but I've always said, never use ice at Starbucks. I've seen a lot of ice machines at a lot of stores and I've never seen one that I'd consider clean enough to trust or even close. Even stores I've worked at where I actually cleaned it regularly, there still is slime mold buildup in impossible to clean locations.
happybowlita83 4 points 1y ago
If you've been noticing things in the ice yourself and didn't contact anyone that could take action after being ignored you mighr be in some trouble too... as someone with a food handlers card you're responsible to report things like this for your own and customers safety. There's numbers everywhere that you can call, like your counties health departmemt not necessarily sbux.

A customer might have better luck with a lawsuit, but you might not win this if there is no record of you reporting it and it being ignored. It would help you if your dr. Finds that the cyst has an abnormal amount of copper traces and then you can maybe file a work injury so the expenses don't come out of your pocket. As others said though your case isn't super valid if you willingly kept consuming and serving something you suspected was contaminated.
luvloping 3 points 1y ago
So the only ice you ever consume ever is starbucks? I hope you don't drink any drinks with ice anywhere else because God only knows what's in their ice.
Its insane people think you will win money from this.
star_pants 2 points 1y ago
Oh yeah our ice machines have a factory defect where the coating on the trays flakes off around the part that pushes the ice out of the tray. The techs know it so when I called in our ice machine and told them about it they kind of did the "oh yeah, they do that, I'll order the part to replace" thing.
Responsible_Snow7109 2 points 1y ago
Oh ive told my shift and manager that there was this salmon colored gross gunk in the ice machine and they didnt care. I showed them ice cubes before with black mold in it about 3 to 4 times and they didnt care. My manager just said to "throw that piece of ice out and rinse the scooper under water" wtff

It’s cause jjs has this list of dbls for you to do weekly. Your always cleaning😂😭
megs1288 2 points 1y ago
Maintenance guy came in to “fix” our espresso machine and when he opened it up there was mold all in it. They sent us an older model replacement… I’m positive Starbucks could easily be sued by multiple stores for issues like this
peachfaeries 1 points 1y ago
i have a cyst in my breast which was caused by hormone imbalance, it is completely non cancerous. just get an ultrasound and if it is really bothering you, you can get a biopsy of it.

I would call a lawyer. They can look into the legality of having metal and copper in food (which definitely sounds illegal, but they would be able to know for sure) and the liability of Starbucks. They can consult medical experts as to whether or not metal and copper consumption poses an increased risk for cancer in the time span of eight months or so. My only concern is that you knowingly ate the ice knowing there was a contaminant in it. Again, a lawyer will be able to assess how much liability Starbucks has for providing that ice in their restaurant both before they were aware of the problem and after you communicated it to them.

Make a record of each instance you communicated to your workplace that you were concerned that there was a contaminant in the ice. If you told people in person, write down an estimate of the date that you did and the people you told. Do this while your memory is fresh. Then make back-up copies of this record. Do not tell anyone at work you're doing any of this.
No-Lawyer631 -3 points 1y ago
I think the OP was unaware of the contamination until after the machine was replaced.
philosopher_cat_lady 1 points 1y ago
She was aware of a contaminant but didn't know what it was
Eastern_Effective_49 0 points 1y ago
Please please please please lawyer up
xoMisaa -6 points 1y ago
Get a lawyer asap. My moms boss has dealt with many cases like this. As long as you have evidence that there was copper in the ice machine and have proof of the cyst then your case is a win. I’m sorry you had to go through that and I wish you the best of luck❤️
