i just promoted to shift and have a question. some of my baristas have been asking for 2 15s or 3 10s instead of a lunch. curious if this is allowed? and if people don't take their lunch and go home 30 min early?

That’s going to be a state law issue regarding the 30 min break. Sbux says that for every 4 hours, you get a paid 10 min break. Your state law will probably dictate the rules pertaining to the 30 min break. Where I live, 6 hours or more gives you a 30 min break. I lived in another state where it was 5 and a half hours or more and you got a 30 min break.

Regardless, this is time theft. They’re asking for 3 10s instead of a 30 so they get paid the extra 30 minutes. Tell them no. You absolutely have that authority, and if they argue, you also have the authority to send them home for insubordination (that’s also punishable by a written action). Just watch your coverage to make sure you won’t be too understaffed if you so so. Also, write that down in the “My Daily” app under the “Staffing and Scheduling” section.

A 30 minute break per 6 hours is the minimum nationwide for Starbucks. I’m in Virginia, which doesn’t have *any* legal requirements for breaks, and that’s still what we get.

I’m in VA as well….but yes, you absolutely should stick to Sbux’s rules. If they’re working a 6 hour shift and you want to send them home having worked 5h45min and only a 10, you could probably do that as a compromise. Again, just be sure you won’t accidentally leave yourself understaffed.

Easy answer: no to everything. Legally they need the clocked out thirty because it is unpaid. Schedules are created to reflect the daily coverage report and breaks are designed to fit the needs of the store. Changes from that can seriously mess with business operation and as a new shift following that schedule is going to make your life much better. Same thing goes with leaving early. Your baristas can leave early but it won’t affect their breaks. They need to legally clock out for a thirty if they work the mandatory hours for a meal. Because a 15/10 min break is paid if they want to leave that amount of time early they can but let them know they’re missing out on hourly pay.

No. What’s on the dcr is what’s needed to be given for breaks. Sure if you can spare someone to be sent home early then Sure do that but if not they need their lunch

If someone needs a different type of break system they can call partner resources for an accomodation.

The only maybe is if your store is seriously cutting hours. Like someone is to work 7 hours, but your sending them home at 4.5 hours then no lunch is okay. They can’t work 6.5 hours with no lunch and go home early though.

Please check your state labor laws. In most states meal periods are legally required if you are scheduled over a certain number of hours.

In general, people are expected to work their scheduled hours. Going home early is usually not allowed without a reason, but talk to your SM if you have questions. ❤️
