is it illegal to give someone their break less than an hour into a seven hour shift ? if i were to take my break and come back i would work 5 consecutive hours before i clocked out (including paid breaks). my shift was insistent on sending me on my lunch but i haven’t been here an hour, and when i explained to her why i think it’s not okay she backed down but now she’s acting as if i was in the wrong.

I believe when you get a lunch the earliest they can send you is 2 hours into your shift

I don’t think you can do that. I’m in Cali as well. I have always been told that you can’t have that 5 hours after your break. Like you have an 8 hour shift. You go to lunch an hour in and than you have the rest of your shift that is 5 or more hours.
If it isn’t. Well that is just rude.

that doesn’t sound right. idk if it’s illegal but it’s certainly not right to send somebody on any kind of break before two hours into their shift, esp not the unpaid one.
