I keep getting scheduled for over 8 hours. Is this even allowed since it’s considered overtime? I never had this happen before with my previous manager.

I worked a 9 hour shift today (I did happen to pick up part of a shift so I knew what I was getting myself into) but in my state it isn't considered overtime. As far as I know, if your state doesn't consider it overtime, they are able to. But I'd talk to your SM to see what's going on when they write the schedule

Anything over 8 hrs in CA is considered overtime for us. That’s why I wasn’t sure if they were actually able to do that because I’ve never had this problem before and no one else has either.

they are because of the thirty minute break it technically makes it a 8 hour shift so no overtime

should have been more specific but the 8.5 hrs isn’t taking my lunch into account, it would technically be considered a 9 hr shift with my lunch

Wait does overtime refer to the hours u get daily or weekly? I thought overtime is referred to weekly as in u cant go over a certain number of hours each week otherwise it would be considered overtime. I didnt realize overtime can also be referred to what u work in a day

I live in California so anything over 8 hrs and working over 40 is overtime. Depending on what state your in the labor laws might be different

True, yea im not sure on my labor laws regarding that specifically. But the most ive ever seen anyone on the schedule for is 8 and a half hours and theres this one coworker who always does his shift and then covers for someone elses shift right after so he works a double. Hes allowed to do that without getting it approved by the DM. So idk what that means for labor laws in my state but i think for my state, the term overtime is only used in regards to someone going over 40 hours a week

it’s certainly legal but i’d clarify with your manager that you are supposed to be getting scheduled with overtime. you’re pretty safe from repercussions if it was your original schedule anyways though.

Yea I’m going to do that! I know some other SSV’s are getting scheduled OT as well. I just found it odd cause they’ve always been super strict about us not working over 8 hrs in a day

If you’re getting a 30 minute lunch then you’re working a full 8 hour shift. That’s how a lot of states do it.

Normally if I schedule someone for an 8.5 hour shift it's to account for a 30 minute break.

After reading a lot of comments and as a California resident, I would like to clarify that you are correct that going over 8 hours in one day is considered overtime (unless you signed a contract, like some nurses work 3 12 hour shifts). However, it is not illegal to schedule you for overtime. Once you hit the 8 hour mark, you should be getting paid time and a half (so for half an hour).

unless you live in a state with daily overtime. most states only have weekly overtime. mine doesn’t have daily so I can work 10+ hour shifts as long as I don’t work over 40 in the week.

My area usually allows overtime in the fall. Cause it gets really busy and so many people change their schedules cause of school. My SM always asks if it's okay.

Overtime refers to weekly hours, not daily. I'm pretty sure 'daily' overtime is more than twelve hours.

I just looked it up and it’s anything over 8hrs daily. But I’m in California so I know we have different labor laws than a lot of other states

You are correct. I’m in CA as well and I’ve worked plenty of overtime in my 15 years here. I’ve gotten a fat check with the daily and weekly overtime I had been approved to work. When they are desperate for coverage they will pay. But it was rarely schedule that way and even in those occasions I was asked if I would like to work overtime. It was never expected or required.

I’m pretty sure for Starbucks, overtime works by every hour you work over 40 hours in one week is 1.5x pay, and not anything you work over 8 hours in one day. :-)

In my state, both of them are considered overtime and anything over 8 hrs counts as OT. I know its dependent by state though
