MA bux employee. I’ve been getting a lot of scheduled 5.75s but I get there early and am usually asked to clock in, going over six hours. Can I insist on taking a thirty? I checked the labor law and if I work six hours I’m entitled to a 30 break. But since I was scheduled 5.75 does that still count? Thanks

if you’re asked to clock in early, let them know you’ll be over 6 hours and would need a 30 worked into the schedule.

If you are consistently asking to clock in early and be pushed over 5.75 hours, I’d talk to Partner Resources about not getting a 30. They really shouldn’t be doing that and consistently not giving you 30s. Also, when i know i am going to be on the floor long enough to require a 30 because my shift was changed, I always ask if I can take a 30 before half of my shift is over so the SSV can plan accordingly. But at the end of the day, the time and inconvenience doesn’t matter as it falls on them and not you. Advocating for yourself is best!

So while yes you’re legally required to receive a break just be aware if you receive that break and you were originally scheduled 5.75 you will in fact be losing hours cause a 6 hr shift take away that .5 would be a 5.5 shift so you might just want to simply tell them you’re unable to clock in early or just don’t walk in the building early if you are worried about being guilted into it.

Yep, they should be counting that. U clocking in early is u working earlier than ur scheduled time so absolutely that should count towards what breaks u get

Look up your state labor laws. Somewhere it would say you work x amount of hours you must get a 30 minute break. But in most places yes it's against the law. I would begin with talking to the manager and informing them of the situation

100%, advocate for yourself. Never be afraid to do that, in any aspect of life, but especially at work. If you know that you will be on the clock for more than 6 hours, even if you were scheduled for less, explain that you will need a 30 min break. If they refuse or brush you off, go to your SM. If that’s not a viable solution, contact your DM. Contact partner resources if you have to, you deserve your breaks. I hope you get this resolved soon and that your SSVs and SM advocate for you and assist you in advocating for yourself.

The saddest part of this is that understanding scheduling, there's never a point where it's damaging to offer you a lunch if you're coming in early to help. They're either saving on labor if it's 15 to 29 minutes early, or getting the extra coverage they needed anyways and with the 30 or more and its easy to adjust the 30 in accordingly otherwise by shifting breaks. If the store is so busy that you need to constantly be in early, they should have the coverage and labor to make up for and adjust for it. Aside from the legality of it, the only other cause I could think of is if they're going off last year's labor to schedule for now, in which case you need to talk to your manager and DM about looking at what's needed based on modern profit, because this will only get worse and worse for everyone as we enter the holidays.

educated guess would be that you are specifically scheduled this shift to avoid giving you a 30 min break - this is often done to have a partner on that can essentially cover all the other breaks in between - while it sucks a bit this is most likely the reason - you can certainly request to be scheduled 6+ hour shifts but I would imagine this is a shift that works well for things like that
