I got a new job... but I'm still on paid sick leave... (self.starbucksbaristas)
submitted by ScarletNebula25
So I had a pretty severe injury last month and I currently still cannot work at Starbucks. However I was offered a job that pays much better and requires a lot less physical effort. So I took it. I want to put in my two weeks, but I don't know if I need to since I still won't even be in the schedule. On top of that I don't know how that will affect my Sedgwick claim. What's the best course of action? I genuinely do care about the people I've spent the last year with, and especially my manager. I just want to make sure I'm respectful and considerate.

A labor lawyer is cheaper than a worker's comp fraud indictment.

I'm sorry, I didn't understand a word you said.

What they meant was that the terms of your claim with Sedgwick very likely include that if you get another job during your claim period, you become ineligible for replacement pay from Starbucks for the hours you missed working. But as we don't know the circumstances of your injury or terms of your claim, you're better off consulting an expert than risking collecting money on fraudulent terms.

Ohhh okay. Where do I find an expert, exactly?

I'd start by just reading through whatever agreements and documents you have from Sedgwick. Honestly it's probably pretty easy to understand on these big points, and I'd be willing to bet that if you get a new job, any compensation for missed pay is canceled from the date your new employment starts. They should continue to cover any medical costs that continue due to your workplace injury. I'd be very surprised by anything other than those conditions, but if you're unsure, you could consult a workers comp lawyer.
