Editing meal punches (self.starbucksbaristas)
submitted by suhpremacy2020
Hi! 365 here, I’ve worked at sbux for about three months now but I started as a minor (17) and recently turned 18 about two months ago. So because I work at a corbrate store we do tens for every four hours (we never get) and a 30 for every six hours and for minors- 30 every four hours. But I have just noticed that my sm has been motifying my punches. Not only my clock in and out (when I stay later and clock in early to help out because we’re under staffed) they’ve been doing that for awhile, but adding in meal breaks when I don’t take them. I’m not one to complain and my availability has been messy through the app PLUS on the daily schedule the shifts look at sometimes it says I get 30s when I work less than six hours as if the system hasn’t updated that I’m 18 or maybe because I’m taking a minors old shift? Idk, but I want to be payed for what I do. I thought about texting them because no one ever has time to talk to them in person ESPECIALLY since we’re understaffed and all my shifts are 5.75. Idk what to do without sounding annoying or immature because they’re something I’m not understanding or missing. Pls help 😩

This is a huge issue they should not be inaccurately modifying your punches. Contact them and if they do not have a legal and morally correct reason to be doing this go to your DM and RM as well. HOURS WORKED ARE HOURS PAID.

I was thinking about reaching out further then my sm but I honestly have no idea where to start and I don’t want it to become awkward with my sm because I didn’t contact them first :’)

I would reach out to them first personally but if you want to start higher start with your DM

Thank you!! 😩

DM, then prtner resources if no solution is met. That’s the proper channels to go through

Luckily here this is no split between moral and legal.

As you noted, time worked is time paid. That is the legal requirement and diverging from that diverges from what is moral.

Yeah honestly when I wrote morally I was like well there definitely isn’t a way to morally not pay your employees

they are intentionally stealing money that you have earned from you in order to save their ass legally. It’s especially bad if they were doing this while you were a minor. If you did not edit these punches yourself in the book, and there’s no text or email history of them confirming these punch modifications are correct, they can get in some serious trouble — I would try notifying someone with knowledge of the labor laws in your area outside of Starbucks, whether that be a lawyer, your local labor board, or a local union branch. They can help you to understand the best process for investigation here that will ensure you get all of the money you are owed.

Edit: since we’re talking months of backpay here it seems, it’s unlikely that you’d effectively solve this with a simple conversation with your SM. they will also take advantage of your age and fewer years of experience and might try to lie to you, etc. I would not personally *start* here unless someone more qualified than me tells you that it’s the best course of action just to ask nicely. But again, they’re breaking the law, and asking nicely isn’t very effective in stopping wage theft imo

Thank you 😭 I was thinking about talking to a coworker I’m close with when I go in today to see if I should even bother talking to my sm

I literally learned this today in the “Paying Our Partners” module. This is not okay, nor approved. It specifically says don’t do this. You should reach out to the DM immediately.

you’re not being immature at all. you are entitled to those wages and you need to escalate this issue if your SM does not correct your punches.

Report any discrepancy that doesn't make sense or that you can't account for. If you're worried about your SM adjusting your punches in a shady way, track your own hours you worked separately but make sure you are as accurate as possible and do not lie in your own tracking.

I know SMs have been fired for this because it is illegal. If they’re doing it to you they’re doing it to other partners.

lol, I wish my manager would do this to me. I'd have a lawsuit slapped on them so fast...

Which is why it'll never happen to me.

Yeah they’re stealing your labor hours to look better for their DM
