Just gonna emphasize the “offered” part. We have partners at my store that don’t want the meal break and we’re not allowed to force it on them.

Starbucks policy is page 8 in the handbook and is to only follow laws and regulations. Federal law doesn’t require the employer to give any breaks. Like at all. *Most* state laws only require that breaks are offered, but don’t require the employer *force* you to take them. Some managers may claim they’re required to, but really in most instances, we just need to keep partner hours within budget so the DM doesn’t get salty.

$1, Starbucks even stated that breaks were “offered”, and that this partner chose not to take them after he made the claim that he was not given his breaks. Starbucks also asked that this partner prove the breaks were not offered in the first place.

Partners are required to take all scheduled breaks. They absolutely can be forced to take a break. Starbucks policy. All the break information is in the partner guide. Take your breaks. Periodt.

Also just want to touch on your “scheduled” bit. The DCR is just a guide. It gives estimated times for breaks, but there are even special instances where the SSV can opt to not offer one or both of the 10s when also given a meal. In my state, this would apply to a 6 hour shift where the DCR might show two 10s and a meal. The SSV can technically (though we would never encourage it at my store) opt to do one meal and one 10 or no 10s at all.

actually in Texas there is no legal requirement to have a break at all. It's Starbucks policy that gives us a break at 6 hours, not any laws.

Precisely why I left Texas. After they ruled that Texans have no actual constitutional rights, i dipped. Lack of workers rights is common. But literally saying I have no rights when I interact with police? Nah. Bye.

On the flipside, I actually liked these shifts. I don't like taking a lunch because it just feels like a waste of time, I'd sit around forever not doing anything (and not getting paid).

You do understand that if you work a 6 hour shift then you get to spend 30 mins of that shift resting right? So you technically work 5 and a half hours.

With a 5.75 shift you’re working 5 hours, 35 mins with only a 10 min break.

You’re getting paid less to work more and you’re happy about that?

5 hours and 45 mins minus 10 mins = 5 hours and 35 mins of work.

6 hours minus 30 mins = 5 hours and 30 mins of work.

You get paid less to do more with a 5.75 shift.

Your logic is incorrect.

5 hours and 45 minutes w/ no meal break= 5 hours and 45 minutes of pay.
6 hours w/ a meal break = 5 hours and 30 minutes of pay.

Honestly this. Unless everyone is drowning, i always gave partners extra breaks if they requested it. Just keep in mind that they may not happen as soon as you ask, other people need breaks too.

I wouldn't go to the bathroom for a whole 10, but 3 or 4 minutes seems reasonable. I usually go to the bathroom within a couple hours of my 10 out of necessity anyway since I drink a whole drink on my break. A couple minutes off the floor is the refresher I need to come back and do a good job the rest of the shift tbh lol

Some people need their breaks though. I, on the other hand, am fine not having a lunch if it means I can leave earlier. I don’t like being there longer than I have to especially not getting paid.

They used to only give me one ten minute break on shifts that long. Then I started getting pissed and not trying to hide it. I had already threatened to quit a few months earlier. We are so short staffed that they caught my drift and started giving me two tens

Another way to look at it though is if you take a lunch break for a six hour shift you’re really only getting 5 1/2 hours, so from a moneymaking standpoint you’re making less money but spending more time there. But I almost always close with one barista so my 30 minute lunch is always paid for

in my state, this would be illegal actually bc our laws require a break at 5 paid hours but I believe the companywide policy allows this unfortunately so it depends on your state

At least in WA state:

​

* First two hours you get a 10 minute break
* After 5 hours you get a lunch (paid or unpaid, but starbucks doesnt pay us for that lol)
* After 6 hours you get a 10 minute break (if only scheduled for 6 hours)

It depends on your state laws. If that were me when I was working id say no unless i either got a lunch or was able to leave 30 minutes before my scheduled time

It sucks but I used to work at Chipotle where I got 0 breaks for 7-8 hours of work... so... I suck it up haha

Fair, no. Depending on state regulations, illegal. California, anything 5 hours or longer requires a 30 minute meal break. I don’t know about other states regulations

Frequently if it’s that close, I have a couple shifts who will ask if I want to do a second ten. And if it’s 6 on the dot I usually get asked if I would rather do that instead of a lunch which I always say yes. Give me that extra 30 min of pay

Not sure where you're located, but where I am it's a requirement that if you hit six hours you get paid extra. My manager still gives us shifts like that, so I usually just clock in five minutes early and then "accidentally" stay five-ten minutes late to get that ot bonus. 🤷‍♀️

Hours are measured in 15 minute increments with regards to meal periods. Check the dcr... I'm very confident on this. If you work 5 and 50 you're entitled to a 30. 5 and 55, 5 and 58,

I've been scheduled 5 and 50 many times, including yesterday, and the DCR does not include a meal break. My state (VA) doesn't mandate breaks at all, so it's also not company policy.

Lol you're wrong though, at 6 hours you get a meal violation but before that you're not entitled to anything more than a 10.
