Hello! First of all I just want to preface this by saying I've never posted in this subreddit before, so please let me know if this is the wrong place to ask/talk about this. Also I hope you're all having a fantastic day :)

TLDR: my store does not give us breaks ever, and its become incredibly unhealthy (and probably illegal)


Anyways, I'm a recently 18 year old female who works a at licensed Sbux store (one inside of a grocery store) and I recently put in my two weeks. I have wanted to bring this problem up for a while now, but knowing I have my notice in and I can't face any repercussions for brining this to light has given me the push to do it.

I've worked at this store for over a year now and I noticed one thing from the start- we do NOT get breaks. I mean ever. From the first week I started there, I never got a break for even five minutes. I'm an opener on the weekends, meaning I get there at 5am and work until 2pm, and not once in the year I've been there have I been allowed a five minute break to eat lunch, sit down, use the restroom, anything. We are told to use the restroom at the beginning of our shift before we clock in, and sometimes we can use it during our shift for \*maybe\* two minutes if we have a break in customers. Its gotten to the point that those of us at the store who menstruate have learned we cannot use tampons while at work, because we aren't allowed adequate time to go to the restroom and change them. Its become so unhealthy (among other things there) that I put my notice in.

Note: Since this is a licensed sbux, I know different rules apply (the store rules are supposed to apply) and the store rules are as follows: employees get one 30 min break during each 8 hour shift, and a 15b min break every 4 hours otherwise. Every other employee at my store OTHER than the sbux employees are required to take these breaks, but apparently we are either exempt from this or they just don't give a shit about us.

Ive talked to my manager about it, and her response to me asking for a break during an almost 10 hour shift was "We dont hire lazy people who need breaks". Thanks.

For the first 10 months I worked there I was 17, meaning in my state (Utah) it was illegal to make me work those hours without those breaks. Now that I'm leaving I want to get this issue brought to someone's attention that can fix it, because the friends of mine how still work there deserve those breaks for the love of god.

Anyways, I just wanna figure out where to report this and how to get it fixed so no one has to deal with it. Pretty sure its illegal and just not right. I'm really sorry this got so long lol ,and please let me know if this is the wrong place the bring this up.

before you leave, access whatever website your information is stored on and download everything. Every pay statement, every punch log, every single thing that relates to information about your time at work. this is a huge, HUGE legal issue that should be taken to your local labor branch/NLRB office — they would have a field day investigating this, but they need evidence. Ask your coworkers that they do the same if they’re quitting or leaving. It’s worth reporting since this is happening to more than just you, and in the circumstance that they’ve broken the law by editing your punches to include a lunch when you haven’t taken one you will be owed money. A lot of it. Thank you so much. I will definitely get a copy of all my punches, and I have several ex coworkers than I’m sure I can get to do the same or at the very least give a statement if they can’t get their records.
I don’t know if they edited my punches to include breaks tbh- there’s always been a “break” and “lunch” button on the system we use to clock in and out but I’ve never used it a single time.

A pattern of missed lunches spanning that amount of time is something I’d usually think would set off red flags among corporate or the people who are in charge of making sure that labor laws are abided by. The fact that there’s been no investigation prior to this makes me want to suspect they’ve been lying about your breaks in order to continue understaffing your kiosk. Good to hear you have some coworkers that would give a statement — the more voices, the better!

I think thats awful! I personally believe it is inhumane to force people to stand, starve, and dehydrate for 6+ hours. Unfortunately, in Utah there is no law surrounding rest breaks for adults :( I am unsure of what the rules entail for a licensed store but I would assume rest/break policy is up to the licensee :(

Call the labor board and make sure you get your punch logs. Your manager may have been editing in means you didn’t take so they didn’t get caught.

Look up your state labor laws. If you're in a right to work state, they don't legally have to give you breaks. It's ridiculous

this is *definitely* untrue. almost every state is right to work, break laws are separate (not every state has them, unfortunately, but right-to-work does not cover working conditions)

Uh oh I didn't mean to spread misinformation! I had been told the breaks or lack there of had to do with right to work... so edit to, look up your states labor laws 🤦🏻‍♀️
