Cheese danishes in the fridge?(self.starbucksbaristas)

Hey guys! We got a random health inspection/audit today and we got docked a major point for keeping cheese danishes on the shelf & not in the fridge? Is this a thing? Like we keep them in the freezer and then pull them on the cart for thawing, and we have them on the pastry cart ready to heat up, but like is that a thing? We’ve gotten audited before and I’ve never gotten points off for cheese danishes not being in the fridge.
They also didn’t say anything about the pumpkin muffins being in the fridge literally just the danishes, so we were kinda confused because this has literally never happened until today.

Probably didn’t really know what they were doing? Cheese danish you buy at say the grocery store are sold on the shelf, like not sure what the true difference is but cream cheese that’s been baked in a pastry is fine at room temp. It’s standard to keep them room temp, and I doubt such a large Corp would be keeping them outside the fridge if it were a code violation

We’ve never put our danishes in the fridge…like others were saying it’s possible the inspector just wasn’t well informed

Maybe they are a new inspector? A copy of the eco sure audit gets sent to your DM and SM. Mention it to your SM and hopefully it can be escalated to your DM to get that taken off!

The inspectors don’t always know what’s going on… got docked months ago for not dating caramel bottles, despite it being in Starbucks CSR standards that condiments used at a high volume that will be gone before their expiration date do not require a date (this was at least true at the time, been gone for a few mo.). I was able to pull it up the second the inspector left on the iPad and show it to my SM. The danishes are most definitely fine on the pastry racks.

Local health department rules should be able to supercede company rules.
If No Name Pizzeria had "corporate rules" saying no refrigeration is required for anything, I really hope local health department rules would override the corporate rules.

this actually inspired me to double check against my local laws, and interestingly enough I could only find something suggesting that the caramel bottles would require a name, but not a date — they had neither, so our bad. Cooked cream cheese on a danish that’s expected to be tossed 48h from thaw is definitely not something I’m even aware of being a threat as far as food safety hazards go, though. Unless they were being thawed improperly, I have to assume OP’s inspectors were misinformed on something…

Oh, I don't think food inspectors are 100% right, 100% of the time. They're human and likely make errors too.
Perhaps they confused it with a custard product? One municipality in my area considers it a hazardous food and it needs to be refrigerated.
That all being said, Starbucks tends to err on the side of the caution, so I don't think there's some major concerns with cheese danishes. If anything, I'd probably get the DM to follow up with the regional health department and clarify what's the law.
Also, I guess this depends if OP's inspection was Ecolab QASA vs local government health department inspectors.

We got docked for not having mats when our store has the special flooring that doesn’t need mats
I pulled up the policy to show our SM and the violation was removed from the report
