What are the rules about half hour breaks? (self.starbucksbaristas)
submitted by iCeleste
So I know that in most states, companies aren't technically required to give breaks at all, but
It was my understanding that any shift that's 6 hours and over gets a half under company policy? Like the DCR prints out the half hour block, and the shift shows up as 5.5 hours because it accounts for the unpaid break.

My SM today wasn't going to let me take my half because apparently I "technically don't get one" for this 3-9 shift? I just didn't quite understand why that would be when I've never heard anything like that before

Company policy is that 6hours scheduled means a 30min break (and 5.5hrs paid)

If it’s printed on the DCR, you’re required to take that break per the partner guide

Ok i thought so - I was very confused when she was saying "yeah I wasn't going to give you a 30, but if you REALLY need it I guess it's ok"

Like... Damn bruh I just wanted to eat dinner and now I feel shitty for wanting to take my allotted break

I’m in California where the law is a little different so not 100% sure this applies to your situation, but sharing anyway in case it’s helpful.

here, you have to take your half “before your fifth hour” - effectively meaning that you get a half for any 5+ hour shift. but it rarely makes sense to schedule someone for a 5 hour shift with a lunch, since they’d only be working 4.5 hours, so they might as well just be scheduled for 4.5 hours (and paid for the whole time). sometimes we have baristas scheduled for a 4 hour or 4.5 hour shift who then are asked to extend up to (but not over) their 5th hour; they don’t take a lunch so that they get paid for the whole time they’re at work. (for the record, this is always voluntary, and the SSV makes sure they understand the situation before they agree.)

again, I’m not 100% sure this applies to you, but it’s the only explanation I can think of. did you get a chance to look at the DCR and see if it scheduled you a half?
