If your a minor that’s… like a 5,000 fine for skipping your break because of labor laws, but because you don’t clock out for your 10 I can imagine your SM just marking it as being done to avoid getting in trouble…
TakeTheWs87 points7m ago
Oh I took a picture of the DCR, which has my break as unmarked during the shift (as well as an iPad in the frame that displays the time being after my shift ended).
lostinluster279171 points7m ago
Just to clarify this point, the company gets fined $5000 and you get paid for 10 minutes for the missed break. I think these things are best ignored because Starbucks has a culture of making it horrible to people who report these kind of things and all the OP will get is 10 minutes of pay. It’s unfortunate but the truth 😐
IOnlyhave5_i_s15 points7m ago
The penalty for missing the bread is an hour pay to the employee. Never heard of a $5k fine. What agency does that?
Kaluskydrak4 points7m ago
10s are paid anyway though, they would’ve gotten paid either way is the problem.
Ordinary-Theory-82896 points7m ago
They worked a 4 hour shift. I don’t think there’s any state that has a mandatory break for a shift that short. Not even NY or California
b99__throwaway54 points7m ago
california has that exact law, actually
bigfoots-rightnipple1 points6m ago
So does Florida
chinksauces29 points7m ago
Hi, my state actually has a law that states any 4 hour shift consecutively worked must be given a paid break.
I live in a blue state that’s historically centered around unions.
not sure what the fine is for minors but I’m sure it’s a hefty one.
Lordofjones20 points7m ago
California had mandatory breaks for four hour shifts.
Apprehensive-You52614 points7m ago
Illinois too
spookbish6912 points7m ago
While come states don’t, Starbucks has created their own policies, hence why minors can only work 20 hours a week. As a previous California resident though tens are required once every two hours and a lunch every four hours, unless the company is unionized and has created different policies
_notaprilbutmayy6 points7m ago
starbucks has their own rules on breaks (all shifts 3+ require one i think); and (at least in my state) minors are required 10 min breaks for any length shift
Ordinary-Theory-82892 points7m ago
Yeah but you’re not getting fined for breaking a Starbucks policy lol
_notaprilbutmayy4 points7m ago
you’re getting fined for breaking minor labor laws lol
echowolf94 points7m ago
If you work more than 2 hours in California then you are required to get a break.
MP7rs31 points7m ago
Whenever I’m working and I can tell that the person running the floor forgot to run my ten I try to ask them “when do you want me to go on my ten” because then hopefully they don’t get annoyed at you for asking for it
JustKam3471 points7m ago
OP said they’ve gotten in trouble for doing that tho
MP7rs6 points7m ago
Yeah but what I’m saying is asking the shift when do they want you to go on your break in case they forgot to send you instead of asking them to go on your right now
lexmackenzie12 points7m ago
We’re all human. I would bring it up if it happens again. And if you get scolded you can now say the last time you didn’t mention it you didn’t get one. 🤷🏽♀️
zoidberg30007 points7m ago
Right? Everyone in here saying to report their SM. Fuck. No wonder y’all are so unhappy. Negative Nancy’s.
yyz_barista11 points7m ago
I'd try to make sure you get paid for the missed break anyways (so you should get paid for 4 hours, 10 minutes (assuming you clocked in and out at the right time). Idk if that's correct, but that's what my store normally did if you missed you break or didn't take it (normally closing, breaks ran late, and it wasn't worth sitting down for 15 minutes).
I'm not sure of your local labour laws so can't comment on that.
b99__throwaway10 points7m ago
ask a shift next time you work for a second 10 that day bc the manager forgot, or sometimes at my store we just write it in the book on the punch communications log & the manger adjusts our end time by 10 minutes. depends on your shifts and your manager tho
thriftysentinal6 points7m ago
Sorry but that’s your fault. They might have forgotten and you need to take it upon yourself and ask for it.
Hazel_is_Trans4 points7m ago
My sm told us we aren’t required to have a 10 during our shifts under 6 hours because it isn’t the law
_notaprilbutmayy3 points7m ago
the partner resource manual says any shift four hours or more (i think, it’s somewhere from 3-4 hours) requires a 10. this is very much against corporate policy 🫣. are the shift following the sm’s rules??
Magicenbykat1 points7m ago
Shifts 4+ hours get one 10, then 6+ hours get a 10 + 30, every 2 hours added gets another 10. Ex: 8 hr shift= 10, 30, another 10.
DCRs schedule the breaks to be every 2 hours (not guaranteed to happen though, depending on staffing and peak 🙃)
Kaiibleu2 points7m ago
There fat lier lol it’s Starbucks law
Ordinary-Theory-82891 points7m ago
Starbucks policy and the law are 2 completely different things lmao
[deleted] [OP]4 points7m ago
Today that happen me I had 7.50 hr shift at 12:30 one my partners notice I hadn’t got my first 10 she brought it up expessally since I have lunch too. My manger was super nice about it. It was miscommunication cause he had do pull due to another shift lead going home sick. And he assume the shift on floor was going do breaks (she did not) he ended up giving my lunch first. Then gave me 10 and I thought myself that I wouldn’t get another 10 since I missed my first one and then 30 mins before my shift ended they gave me one more 10 I was shocked
RosieHarlan3 points7m ago
Did you clock in at exactly your start time and not at all a minute or more late? Your SM could have been being petty since a break is for 4+ hour shifts and not anything less.
stalediced8 points7m ago
I’ve actually been told by my SM that anything over 3hr 15min gets a 10, not just 4hrs+
spookbish693 points7m ago
Just got a ten for a 3.50 hr shift today, it’s Starbucks policy
RosieHarlan1 points7m ago
That might be your state laws but I’ve never heard of state that has a law about mandated breaks for less than 4 hours.
Kaiibleu1 points7m ago
Either way there a minor a break is literally required for them
Summycat5102 points7m ago
as a barista who is a minor also in the us, they’re required to give me a half every four hours. It could be my state or something but I would double check
Vincent_Cromwell272 points7m ago
If you write in punch communication “missed 10” instead of the time, you get paid an extra hour of pay. That way the dm can see it too when they audit the book.
HarleySpicedLatte1 points7m ago
Where is this written?
Vincent_Cromwell272 points7m ago
I’m unaware of any written policy, but my dm informed us ssvs at a meeting, and then warned that they follow up if they notice it being abused or too many times
HarleySpicedLatte2 points7m ago
I'm gonna try to find information on this. Thanks
Vincent_Cromwell272 points7m ago
Of course!😁
lewabwee1 points7m ago
People forget sometimes. I don’t know what kind of scolding you’ve gotten before but if they forgot a ten once it’s not the biggest deal in and of itself. I’m not saying it’s good I’m just saying it’s pretty human during a stressful shift to forget something (and everyone has specific expectations on when and when not to say sorry I’ve been scolded for saying sorry so many times when I make mistakes at work).
The scolding might be more of a problem. It’s hard to say without specific details or insight into what exactly happened or how many times or if they were annoyed at the situation and had a moment of weakness or if they’re annoyed with you specifically.
tourniquette21 points7m ago
What state are you in? This needs to be reported to your state’s labor board. Most of them have online forms or email address of people you can contact. But your SM absolutely needs to be reported. I’d also recommend making contact with your DM or reporting it as a violation through the ethics violation line.
Luckily Starbucks has a few ways you can go to handle it if you’re not comfortable talking directly to your manager, which is understandable in lots of cases.
1. You could find your favorite SSV and ask them to mediate for you or to essentially present your case to the SM for you. Or even your ASM if they’re cool.
2. Contact your DM and explain that you’re nervous about speaking directly to your manager. Ask them to handle it instead of it being on your shoulders. Because you shouldn’t have to tell them when it’s time for your break.
3. Contact corporate directly. They can put you in touch with the appropriate department, like whatever HR looks like for us.
4. Report it through the ethics violation line.
5. Report it directly to your state if it’s an ongoing problem that isn’t being resolved.
You being a minor makes this fairly problematic. If you need help coming up with the right things to say or locating the right phone numbers and contacts, just let me know. I’ll do my best to find the right resources for you.
Buffcats4201 points7m ago
Not at Starbucks but I worked a 10 hour shift with no lunch/no break, they scolded me like it was my fault. I didn’t realize I could fight back, if this were to happen again does anyone have any recommendations?
R1P2MYOUTH1 points7m ago
this has been happening to me far too often lately🙃 i really hope you can get it sorted out, it's messed up, ESPECIALLY if you're a minor
Kaiibleu1 points7m ago
Bestie all you have to do is call ethics and compliance it can be found in the big daily record books or on partner hub
Stunkydunk1 points7m ago
Call partner resources!
Less-Ad32930 points7m ago
Honestly I’ve gone longer shifts without getting a break but if you feel for you personally this is a bigger issue then I would talk to them, as a supervisor I know it gets crazy and we have a lot going on so we try our best but sometimes having the barista remind us helps us out too so we can do our job better. I’m sorry you missed your break, you can always confront them and see if maybe you would be able to make up the 10 on another shift? I hope they show you understanding and and consideration to prevent this from happening again and hopefully they can help you in this matter to correct it.
