Okay so this happened a week ago, Dec. 4.

It's inventory day right, keep in mind we are a licensed starbucks, vonsbucks.

Okay so my boss comes in at 3 in the morning to do inventory and I come in a 530 to open the store and the second comes in at 630.

My boss's schedule that day was 3 to 8am inventory and waiting around for our store manage.(while she was waiting she was grabbing things from our storage and putting it into the kiosk)

So from the time the kiosk opened and until she left at 1030 (because store manager was busy), the whole five hours we have been opened she helped all of five minutes and thats it.

Me and my second earned about 75 dollars total in tips. Thinking we're only going to cut this two ways, since we're doing all of the work and engaging with customers.

JUST THE TWO OF US.

My boss comes over and does it three ways.

And that pissed me off so bad.

She tells us that she still gets tips because she is clocked in.

But you have only made three drinks in the five hours we were open.

You don't deserve the tips because you haven't help much.

My question is, is it fair for her to take the tips if she hasn't contributed anything but the three drinks?

Managers receiving tips in the first place makes no sense to me. You give up the luxury of receiving tips in lieu of an increased salary when becoming a manager. Helping your employees does not warrant the right to be tipped. Helping your employees when it's busy is the very bare minimum and is nothing special.

is that not illegal? at least in corporate stores thats why sm’s/asm’s aren’t allowed to get tips

I’m pretty sure that’s illegal, although it may depend on the state you live in & its rules. Managers who have certain duties such as scheduling are not allowed to collect tips in a tip pool like that. A restaurant in my area actually got a huge fine because the manager and some supervisors who met that criteria had been continuously included in the tip pool.

My SM and ASM aren’t even allowed to touch the tips. I’m sorry you guys had to deal with this, definitely seems unfair to you guys.
