OSHA, local heath code, and common decency aside I can still confirm that Starbucks will not be allowed to stay open without at least one working restroom. I've closed stores multiple times as an SM and waited around for a plumber. If anyone has contact for your Regional Director you need to contact them. Should be posted in back of house.

Oh wow, a critical health code violation, Starbucks policy violation, and OSHA violation all in one! I saw that you left already but contact the shift currently in charge to shut down operations IMMEDIATELY. Send partners to other stores in the district to complete their shifts. They do not need to stay to close the store as it is an unfit environment to work in until that bathroom is back up and running. If the DM tries to write anyone up, cite OSHA, Partner Handbook and local health code to back them up. By absolutely no means should they stay in the building if there isn’t at least one restroom available.

Don’t do this OP, the SSV isn’t allowed to make this call OSHA violation or not. They will likely be separated immediately - there’s nothing in the partner guide about bathroom accessibility and if there is a public bathroom within a reasonable distance it’s technically not an OSHA violation.

SSVs are and have been empowered to make the call to shut down operations in regards to partner safety. A DM can certainly try to separate, but it would never be upheld if brought to PCC and Ethics & Compliance. No one can be held accountable for refusing to work in unsafe conditions that violate the law. I know this because a similar situation had happened to me as an SSV with my DM threatening to fire me and I had to get PCC involved.

No partner restroom available is a CRITICAL violation, per FSA.

Per Safety & Security Manual, (Jan 2022 update): “All partners have a Right to Refuse unsafe work. If at any time a partner feels that a procedure, task, or condition of their workplace is unsafe, the partner may refuse to complete the procedure or task. The partner must immediately report the work refusal to their shift lead or manager.” If all partners refuse to work in a store with critical violations, then the store cannot operate and must close.

I have shut down the store as a shift (drains overflowing) and the DM was pissed. Never got a write up or anything, but that store was a money-printing dumpster fire and I'm sure the DM wanted to punish me if he could.

Though, if there were reasonable bathroom accommodations (public restroom nearby) it's likely not an OSHA violation nor a reason to shut down.

I would agree with the last bit, but it could get dicey real fast. What if there is no public restroom available nearby? What if there is, but that public restroom becomes unavailable? On a two-man it would become a cash handling violation for one person to leave the premises to use a nearby public restroom, so what do they do then? In certain areas that require food licenses for supervisors, it’s required that at least one license-holder be in the premises at all times; what does the shift do if they need the restroom?

If a store cannot provide a restroom on-site for partner use, it can and should be shut down. DMs can whine all they want but PCC will never not side with partners for shutting down due to critical violations.

They did this to me when I worked at Claire’s and said I could use the bathroom in the mall but wouldn’t let me close the store to go use it???? Report it, it ain’t worth it. Looking back I’m pissed I didn’t.

well it was 6am on a Saturday. The closest stores didn’t open until 10:30/10:45. We designated one toilet for emergencies only and i guess after I left at 9 they started working again, but no plumber. All luck i guess🤷🏼‍♀️ either way we were without a proper working toilet for 3 hours

For fun, the specifics are if your lobby seats more than 20 guests (forget if that includes workers), a restroom must be available for customer use by food code. The expectation is that customers have a clean place to relieve themselves as well as wash their hands before consumption of goods.
