i have been trying to get accommodations for sleep disorders and other disabilities for about two months.
i requested for flexible schedule and it was denied so my partner resources person brought up a consistent schedule to work evenings instead accommodation and i agreed and she told me shed get back to me abt it.
i have just received my final written warning for all the things my disabilities have caused with time and attendance during trying to get the accommodation because the case was closed and accommodations were denied.
nothing was further discussed with me, but since it was denied my SM said it was necessary to discipline me for my time and attendance and said she should have been even while me trying to get the accommodation.
is this discrimination according to the ADA?
i read this:
An employer refuses to make “reasonable accommodations” — changes to how a job is done so that you can have an equal chance to succeed at your work
im being blamed for the lack of communication to me though i was in the dark about everything. and im about to lose my job, i go to ASU and am a three year partner. please help me.

What about just making your availability to work between certain hours? If you are available 7 days a week from open to close they can schedule whenever. If you change your available work time to set hours that you CAN show up for, this seems like an easy way to fix the problem. If you are saying that you will always be late no matter what time is set for you, then perhaps you should find a different job.

this is what i wanted but bc of it being through the accommodation i was now required to work with them to figure it out. the original request was to stay working mornings so that was what i was going for when i was getting the og accommodation, so to fix the issue it would have to be thru the accommodation but they didnt give me the opportunity to know what was going on. it sounded like my accommodation went thru at first and i was confused. just a lot of miscommunication (there was also an overlapping availability that has been causing an issue for two weeks but my sm said that i should have known abt it and came to her and she was confused why i didnt so she didnt bother to lmk)

What accommodations were you looking for? I’m not sure what you mean by how a flexible schedule would accommodate your disability.

Unfortunately from the ADA quote you posted, it states that reasonable accommodations are changes to a job while you are at the job and says nothing about missed time and scheduling. If you are missing a lot of time bc of your disabilities, applying sick time would protect you from write ups and you could change your availability yourself.

I missed a lot of time while I was pregnant bc of nausea and vomiting and there was nothing they could do about it bc I used protected sick time and pregnancy is in a protected class of disabilities.

yeah im in a pickle. i have a sleep disability than causes me to not be able to wake/hear consistently. at first i asked for a flexible schedule bc thats what most businesses do for ppl w sleep disabilities, which means like 0-# min late = 0-# min stay longer, and alter shifts as u go.

i then was told that this would not work w sbux and i was like thats totally okay id be willing to figure something else out if thats my only option (i avoided working nights for mental disorder reasons) which to that we thought having a same time schedule every shift would help w routine and help w my disability. apparently this was also denied (though suggested by my representative) and then never communicated and they decided to close the case instead of perhaps suggest changing my availability or smthn to prevent me from being scheduled mornings and hope theyll be as consistent as possible yk.. it just feels off that my rep, SM, and DM all made a decision and never let me know it was made, so i had been waiting to hear back while they were already formulating my final warning.

i asked today if i could use sick time to cover the portions of my shifts i miss for my disability and i was told i cannot bc u cannot use sick time after the occurrence but it must be known before the shift that you will need sick time usage.

honestly accommodations can only go so far and starbucks might just not be a job that can work with what you need. it’s job where people coming to every shift on time is extremely important in order for the store to run properly, so if you can’t ensure you’ll be there at the time you’re scheduled and also can’t work at night they might just have nothing they can do for you

this is true but i did agree to the second accommodation offer of working like a 2:30-10:30 every time i have a shift. which was then lost somewhere im communication and im now confused cuz ive adjusted to being open to working nights cuz the symptoms have gotten worse

i completely agree with you but with the ADA they cant just push it all away and not lmk anything and then blame me for it 😪

being restricted to only that time slot might not work with the availability from everyone else does, especially if they already have an abundance of closers. i agree they should’ve told you and they definitely didn’t do a good job handling the issue, but some jobs just can’t be accommodated
